GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn't provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and "send thousands of metal shards into the fuel injection system and every part of the engine." The Detroit News reported on the most recent lawsuit filed in Michigan's Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A.  The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don't know how many other suits might have been filed, but the two suits mentioned apparently didn't have legs — the courts dismissed both quickly. So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM's motion to dismiss, noting "the alleged defect is central to the vehicleÂ’s function." This latest suit filed on Aug. 6 in Detroit singles out GM again.  The Bosch CP4 is known to be problematic, however.

Ford exec reveals new F-150 Raptor packs 450 horsepower

Between the new GT supercar, Shelby GT350R muscle car and F-150 Raptor off-roader, Ford had quite the array of performance machinery on display at the Detroit Auto Show earlier this month. One thing it didn't reveal about any of the three, however, is how much power they'd pack, but a senior executive at the Blue Oval automaker has reportedly let the cat out of the bag when it comes to the Raptor. During a televised interview during the Rolex 24 at Daytona this past weekend, Ford's product development chief Raj Nair is said to have revealed that the new F-150 Raptor will offer 450 horsepower. That's pretty impressive from a 3.5-liter turbocharged V6, and would put the new Raptor out ahead of the 411 hp produced by the 6.2-liter naturally aspirated V8 in the previous SVT Raptor. That doesn't give us the whole picture, though, because in a vehicle this big especially, torque will play a huge factor. The outgoing Raptor offered 424 pound-feet of twist, and the existing 3.5-liter EcoBoost engine is already producing 420 lb-ft – so it seems fairly safe to assume the new Raptor will eclipse those figures as well, but we'll have to wait for official word to find out for sure. Dealers price gouging Ford Mustang 50th Anniversary Edition by up to $20k [UPDATE]

UPDATE: Sheehy Ford's Cory Belcher got back to us, confirming that the price premium was related to the limited nature of the 50th Anniversary Mustang and that the figure listed was based on what other dealers were charging, while adding that the dealership was "very flexible" on the final price of the special edition car. So while there remains a hefty markup, it's possible that consumers could get out the door without spending quite so much over MSRP. It's no secret that dealers take some – let's call them "liberties" – with the prices on vehicles that are very new, highly in demand or available in very limited numbers. As we've explained before, they're well within their rights to charge so-called market value adjustments. We don't usually see these adjustments on mainstream vehicles, though. Then again, you could argue that the 2015 Ford Mustang 50th Anniversary Edition is not necessarily a mainstream vehicle. It starts at $46,170, which isn't peanuts, but it's still a Mustang. There's still a large portion of the buying public that could put one in their driveway, if they so chose. Then again, maybe they can't. That's because dealers are (still) issuing massive premiums on top of MSRP for the limited-edition model. It's happening at Sheehy Ford Gaithersburg, where a salesperson named Lou confirmed to Autoblog that the dealership is charging around $20,000 over MSRP on not one, but two Anniversary Editions. He explained that Sheehy isn't alone in the upcharge: "We like to see what other dealers are asking for," he told us, in reference to the limited edition 'Stang. We have a message in for the dealership's general manager for deeper info, too, and will update this post when/if we hear back. We corroborated Lou's story, though, with another Maryland area dealer, Century Ford, who confirmed that the $46,995 listed on the dealer's website for its Wimbledon White Anniversary car was incorrect, and the actual price was "around $64,000." He echoed Lou's reasoning for the upcharge, while adding that dealers are likely only going to see one or two examples, of the 1,964 produced. Perhaps the most worrying part of this entire affair is the sense of deceit that accompanies it. Neither of the dealers we spoke to copped to the market value adjustments on their website. We had to call and ask specifically about the cars in question to get the actual price.
