Ford hit by lawsuit over hybrid technology from, surprise, Paice

The name Paice will be familiar to anyone who's been deep in the weeds of hybrid history, but it will probably be new to anyone who simply drives one. The key part of the story is something called "HyperDrive," which is the name given to a gas-electric powertrain technology developed by Alex Severinsky and patented in 1994. HyperDrive is a way to get the energy from both the electric battery and the engine into the wheels, seamlessly. The patents are held by Paice, which is an unusual company (its HQ is a house in a retirement community, right by a golf course) that does nothing but litigate. You can read more on Paice here. The latest case targets Ford and the hybrid and plug-in versions of the C-Max and Fusion models as well as the Lincoln MKZ. Paice claims that it held "over 100 meetings and interactions with Ford" between 1999 and 2004, and gave the automaker, "detailed information about the hybrid technology that Paice had developed." The suit also alleges that: For more than five years, Paice answered inquiries from multiple departments within Ford, believing in good faith that a business relationship between Paice and Ford would be mutually beneficial and advance the acceptance of Paice's technology. ... After years of Ford learning the details of Paice's hybrid drivetrain technology, Ford elected not to enter into a business relationship with Paice. The suit is officially known as, "Paice LLC v. The Ford Motor Co., 14-492, U.S. District Court for the District of Maryland (Baltimore)" and you can read the PDF here. Ford told AutoblogGreen, "we do not comment on pending litigation." Toyota settled a similar patent-infringement case in 2010 and now pays Paice almost $100 for every hybrid it sells. Paice is still in court against Hyundai and Kia. In 2010, Ford also settled with Paice but they agreed to keep negotiating on other issues until at least January 1, 2014. With that date now in the past, it didn't take long for Paice to file papers to get the two sides back before a judge. That's where it appears to be most comfortable.

2015 Shelby GT bows in Scottsdale with 627 supercharged ponies

Between the base V6, the EcoBoost turbo four, the eight-cylinder GT, the monstrous GT350 and the new GT350R (to say nothing of transmission and convertible options), muscle-car enthusiasts have a staggering array of Mustangs to choose from. And now there's one more as Shelby American has introduced the new 2015 Shelby GT. Building off the success of the 2007 Shelby GT and the 2013 follow-up, the new 2015 model was just introduced at the Ford booth at Barrett-Jackson in Scottsdale, AZ. It's based on the latest Mustang GT (whether factory fresh or commissioned from an owner's existing pony car) but upgrades with an enviable list of enhancements from Ford Racing Performance Parts, Shelby's own upgrades and top-shelf third-party components. For starters, the engine is supercharged up to 627 horsepower (with over 700 available through further upgrades). It's got 3.73 gears, a Borla exhaust, WELD Racing wheels, Michelin tires and Wilwood six-piston front brakes. Visual enhancements include a carbon-fiber body-kit (including a two-piece rear diffuser) and billet aluminum front grilles. Designed from the get-go to be sold around the world, the 2015 Shelby GT is certified for use in all 50 states and comes with a Shelby American CSM number registered in the company's registry, but all those enhancements don't come cheap: Shelby's charging $39,995 for the new GT, and that's just for the modifications. Add that to the $32k sticker on a Mustang GT donor and you're looking at over $70k – which is not only more than Ford itself is expected to charge for its own GT350, but more than Dodge gets for a Challenger Hellcat. Lincoln MKC recalled because start button located too close to touchscreen [UPDATE]

UPDATE: Ford spokesperson Kelli Felker responded to our questions and let us know that the fix for the push-button start on the 2015 MKC has the switch moved to the top of the of the column of gear shift buttons instead of the bottom. Owners should be notified about both campaigns "toward the end of February." After massive campaigns from General Motors and to fix Takata airbag inflators, 2014 will undoubtedly go down as The Year Of The Recall. And with little time to spare, Ford is getting in just under the wire to adding two more to its yearly total. The larger of the campaigns is actually one of the most bizarre campaigns we've heard of all year. Lincoln is recalling 13,574 units of its 2015 MKC compact crossover in North America to move the location of the push-button ignition switch on the dashboard. According to the automaker's announcement: "Due to the switch's close proximity to other controls, occupants are inadvertently shutting off the engine while driving." The button is located near the bottom of the touchscreen, which can apparently make it possible to hit by mistake. Back when Autoblog first drove the new MKC in June, we came away very impressed, but noted: "... we're still not completely sold on the aforementioned pushbutton transmission selector ... it still seems somewhat gimmicky and it can't be operated by feel alone, as you might when shifting a traditional console-mounted lever from Park to Drive." According to Lincoln, there have been no reported accidents or injuries stemming from this button misapplication. Of the affected vehicles, there are 11,144 in the US, 2,033 in Canada and 397 in Mexico. To fix the problem, dealers are moving the button to a different location and reprogramming the powertrain control module. According to Automotive News, models built since September already have a different layout. The change was reportedly done to match the rest of the Lincoln lineup. The second recall covers 12,205 units of the 2014 Ford Escape (2015 model year pictured below) and 2015 Lincoln MKC in North America because of a problem with nickel plating on the fuel pump. The issue can cause the pump to seize, which can cause the crossovers not to start or stall while driving. The automaker is not aware of any accidents or injuries related to this fault. Dealers are replacing the fuel deliver module to fix the situation. Of the affected vehicles, there are 9,038 in the US, 3,074 in Canada and 93 in Mexico.
