Federal judge throws out GM's racketeering lawsuit against Fiat Chrysler

  DETROIT — A federal judge on Wednesday threw out a racketeering lawsuit General Motors had filed against smaller rival Fiat Chrysler Automobiles, saying the No. 1 U.S. automaker's alleged injuries were not caused by FCA's alleged violations. GM officials said in statement they "strongly disagree" with the order by U.S. District Court Judge Paul Borman, whom the automaker had sought to have removed from the case, and would appeal. "There is more than enough evidence from the guilty pleas of former FCA executives to conclude that the company engaged in racketeering, our complaint was timely and showed in detail how their multi-million dollar bribes caused direct harm to GM," GM said in a statement. The Detroit company added that Borman's decision "would let wrongdoers off the hook." GM filed the racketeering lawsuit against FCA last November, alleging its rival bribed United Auto Workers (UAW) union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. GM was seeking "substantial damages" that one analyst said could have totaled at least $6 billion. FCA had called the case meritless and asked Borman to dismiss it. On Wednesday, Borman dismissed the lawsuit "with prejudice," meaning GM cannot refile the complaint. "The direct victims of defendants' alleged bribery scheme are FCA's workers," Borman wrote of FCA. "GM's high labor costs were not an injury proximately caused by FCA's bribes, and any competitive injury that GM suffered as a result of FCA's advantage in labor costs is an indirect injury." "The dismissal of GM's complaint with prejudice earlier today vindicates our position," FCA said in a statement. On Monday, the Sixth U.S. Circuit Court of Appeals denied GM's petition to remove Borman from the case, but said the two automakers' chief executives didn't have to meet to try to settle the case as Borman had ordered. Junkyard Gem: 1978 Chrysler LeBaron Coupe

From the early 1930s through the middle 1970s, Chrysler used the LeBaron name (taken from a coachbuilder eventually consumed by the car company, much as Fleetwood and Ghia were absorbed by GM and Ford, respectively) on high-end Imperial models. Then, facing decreased demand for mammoth land yachts thanks to certain geopolitical events, Chrysler created a separate LeBaron model, based on the midsize platform used for the Dodge Diplomat/Plymouth Gran Fury. Production of this LeBaron began in 1977 and continued until the debut of Lee Iacocca's famous K-Car LeBarons for the 1982 model year. While you'll find the occasional Diplomat these days, the 1977-1981 LeBaron has become all but extinct. Here's a crash-victim '78 in a Denver car graveyard. Plenty of times, I'll find discarded cars of this era that seem to have moldered outside for decade after neglected decade, but this one drove to its final crash. That means that the 318-cubic-inch (5.2-liter) V8 under the hood would be a good bet to buy for another Chrysler project… but nobody seems interested, because this Malaise Era engine made only 140 horsepower when new. The base engine in the 1978 LeBaron was a 110-horse Slant-6, so at least this car had the upgrade. Sure, the Diplomat was the not-so-plush successor to the non-plush Aspen/Volare and the even-less-plush Dart/Valiant, but Chrysler installed a reasonably nice interior in the Diplomat's Chrysler-badged sibling. This one has the standard "Cortez" cloth-and-vinyl bench seat, but not the optional power windows or door locks. This one has stickers for Run-D.M.C., Public Enemy, Slayer, and MegadethÂ… plus one for the Oakland Raiders, hated rivals of Denver's local sportsball team. I'm pretty sure the car was not being driven by the original purchaser when it crashed. Believe it or not, this car was available with a four-on-the-floor manual transmission and a V8 engine. Chrysler officially rebrands as FCA US LLC

Detroit's third-largest automaker has had a lot of names over the years. It was founded as the Chrysler Corporation in 1925, a name it held until 1998 when it was bought by ze Germans in 1998 to form DaimlerChrysler AG, then it went independent in 2007 under the name Chrysler LLC before being retitled once again as Chrysler Group LLC in 2009. And now the automaker headquartered in Auburn Hills, MI, is getting yet another new name. Announced today and effective immediately, the company formerly known as Chrysler will now be called FCA US LLC. That's a lot of letters, but they make a lot of sense, too: FCA stands for Fiat Chrysler Automobiles, the US telling us this is the company's American division and the LLC tells us it's a limited liability company – a legal classification similar to (but not quite the same as) a corporation. The announcement comes shortly after the company decided to phase out its long-serving Pentastar logo. The sum total is that the once-independent industrial giant is now formally part of a larger European parent company, owned by Fiat and (for taxation purposes, anyway) based in the Netherlands. What the company formerly known as Chrysler wants to emphasize, however, is that FCA US LLC will remain based in Auburn Hills and retain its "holdings, management team, board [and] brands."
