Judge refuses to reconsider GM lawsuit against Fiat Chrysler

A federal judge in Detroit said Friday that he will not reconsider his July dismissal of General Motors’ racketeering lawsuit against Fiat Chrysler Automobiles. U.S. District Judge Paul Borman wrote in an opinion that new evidence presented by GM regarding bribes and foreign bank accounts “is too speculative to warrant reopening” the case. Borman also ruled that the earlier dismissal of the case was not done in legal error. GM alleged that FCA used foreign bank accounts to pay bribes to former United Auto Workers Presidents Dennis Williams and Ron Gettelfinger, as well as Vice President Joe Ashton. It also alleges that money was paid to GM employees including Al Iacobelli, a former FCA labor negotiator who was hired and later released by GM. GM said the payments were made so the officials would saddle GM with more than $1 billion in additional labor costs. “Even if the affidavits establish that these foreign bank accounts exist, that fact does not rise to the inference advanced by GM, that FCA was more-than-likely using the bank accounts to bribe UAW officials,” BormanÂ’s order stated. GM said Friday that it would appeal BormanÂ’s ruling to the Sixth Circuit Court of Appeals. “TodayÂ’s decision is disappointing, as the corruption in this case is proven given the many guilty pleas from the ongoing federal investigation,” GM said in a statement. “GMÂ’s suit will continue — we will not accept corruption.” FCA lawyers wrote in court documents that allegations it bribed union officials are “preposterous” and read like a script from a “third-rate spy movie.” Gettelfinger denied the allegations in a statement and said he had no foreign accounts. WilliamsÂ’ California home was raided by federal agents but he has not been charged. Iacobelli, who is awaiting sentencing in the federal corruption probe, also denied the claims. “Judge BormanÂ’s ruling this morning once again confirms what we have said from the beginning — that GMÂ’s lawsuit is meritless and its attempt to submit an amended complaint under the guise of asking the court to change its mind was nothing more than a baseless attempt to smear a competitor that is winning in the marketplace,” FCA said Friday in a statement. FCA eliminates just under 2,000 supplemental contract workers due to coronavirus constraints

Car companies have jumped in quickly to help combat coronavirus. They’re even beginning to manufacture some of the badly needed medical supplies, like ventilators and masks. However, with stay-at-home orders sweeping across the nation and folks practicing social distancing, automotive sales and manufacturing have quickly dried up in North America. That leads us to todayÂ’s news coming out of FCA. A company spokesperson told us that approximately 2,000 supplemental workers (a subcategory of the companyÂ’s many contract workers) are being laid off. HereÂ’s the official statement from FCA: “In light of the challenges created by the COVID 19 situation, and the various ‘stay at homeÂ’ orders from multiple states, a number of development projects within FCA have been temporarily put on hold. "As a result of this, subcontract companies who were providing external support to a number of these projects have been asked to temporarily suspend their activities as we reprioritize certain initiatives and projects. We will continue to monitor the situation with the intent to return to normal activity as soon as the situation allows.” FCA made it clear in our communications with the company that it is not terminating all contract workers, nor is it terminating any employees of the company itself. The rationale here is that certain development work is on pause, so those who were contracted to be a part of that work are now out. We're told that those workers are in white-collar functions, not manufacturing jobs. We asked FCA if it had plans to reinstate all of the affected workers once the coronavirus crisis has passed, but received no commitment either way. “At this point weÂ’re going to continue to monitor the situation,” a company spokesperson told us. Questions still remain when it comes to the stimulus package moving through Congress right now as it pertains to the automotive industry. FCA says itÂ’s currently studying the bill, but hasnÂ’t offered up a comment on the situation yet. Junkyard Gem: 2002 Chrysler PT Cruiser Convertible Conversion

Chrysler started selling PT Cruisers for the 2001 model year, and these "trucks" (yes, they were considered trucks for American regulatory purposes) proved quite popular for at least the first half of the 2000s. A factory-built version with a convertible top appeared for 2005 (and later "won" the Top Gear Worst Car of the Last 20 Years award), but what about the PT Cruiser shoppers who wanted a drop-top before then? It turns out the aftermarket had the solution: the Newport Convertible Engineering conversion, which took new PT Cruisers and added a fully functioning convertible top. According to a discussion on Allpar, 54 of these conversions were performed, and I found one of them in a Denver-area self-service yard last month. Newport Convertible Engineering is still around, though they're in Huntington Beach instead of Placentia these days. If you want a Tesla Model S or Range Rover convertible, they'll build it for you. The NCE conversion for the PT Cruiser cost $9,900 (about $15,715 in 2022 dollars) plus the $17,000 sticker price of a new PT Cruiser, and included the needed chassis-stiffening modifications and a shortened, hydraulically-actuated rear hatch. The materials used look pretty good, even after 20 years of abuse and neglect. This one had the convertible mechanism ziptied shut in many locations when I found it. Naturally, I cut all those zipties to see if the roof mechanism still worked. It was very, very stiff but proved semi-functional (the zipties appeared to be an attempt to keep a faulty latch mechanism from letting the roof pop open at speed). The roof assembly weighs a lot, though you could spend an extra $3,000 to get a power-actuation system from NCE. This cab must have been extremely noisy and buffety with the top down at speed, but so what? Convertibles are cool. Mechanically, it's an ordinary Touring Edition with a Neon's 2.4-liter four-cylinder making 150 horsepower. You could get a PT Cruiser with a five-speed manual transmission, and many did, but this one has the extra-cost automatic.
