Federal judge throws out GM's racketeering lawsuit against Fiat Chrysler

  DETROIT — A federal judge on Wednesday threw out a racketeering lawsuit General Motors had filed against smaller rival Fiat Chrysler Automobiles, saying the No. 1 U.S. automaker's alleged injuries were not caused by FCA's alleged violations. GM officials said in statement they "strongly disagree" with the order by U.S. District Court Judge Paul Borman, whom the automaker had sought to have removed from the case, and would appeal. "There is more than enough evidence from the guilty pleas of former FCA executives to conclude that the company engaged in racketeering, our complaint was timely and showed in detail how their multi-million dollar bribes caused direct harm to GM," GM said in a statement. The Detroit company added that Borman's decision "would let wrongdoers off the hook." GM filed the racketeering lawsuit against FCA last November, alleging its rival bribed United Auto Workers (UAW) union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. GM was seeking "substantial damages" that one analyst said could have totaled at least $6 billion. FCA had called the case meritless and asked Borman to dismiss it. On Wednesday, Borman dismissed the lawsuit "with prejudice," meaning GM cannot refile the complaint. "The direct victims of defendants' alleged bribery scheme are FCA's workers," Borman wrote of FCA. "GM's high labor costs were not an injury proximately caused by FCA's bribes, and any competitive injury that GM suffered as a result of FCA's advantage in labor costs is an indirect injury." "The dismissal of GM's complaint with prejudice earlier today vindicates our position," FCA said in a statement. On Monday, the Sixth U.S. Circuit Court of Appeals denied GM's petition to remove Borman from the case, but said the two automakers' chief executives didn't have to meet to try to settle the case as Borman had ordered. Junkyard Gem: 2002 Chrysler PT Cruiser Convertible Conversion

Chrysler started selling PT Cruisers for the 2001 model year, and these "trucks" (yes, they were considered trucks for American regulatory purposes) proved quite popular for at least the first half of the 2000s. A factory-built version with a convertible top appeared for 2005 (and later "won" the Top Gear Worst Car of the Last 20 Years award), but what about the PT Cruiser shoppers who wanted a drop-top before then? It turns out the aftermarket had the solution: the Newport Convertible Engineering conversion, which took new PT Cruisers and added a fully functioning convertible top. According to a discussion on Allpar, 54 of these conversions were performed, and I found one of them in a Denver-area self-service yard last month. Newport Convertible Engineering is still around, though they're in Huntington Beach instead of Placentia these days. If you want a Tesla Model S or Range Rover convertible, they'll build it for you. The NCE conversion for the PT Cruiser cost $9,900 (about $15,715 in 2022 dollars) plus the $17,000 sticker price of a new PT Cruiser, and included the needed chassis-stiffening modifications and a shortened, hydraulically-actuated rear hatch. The materials used look pretty good, even after 20 years of abuse and neglect. This one had the convertible mechanism ziptied shut in many locations when I found it. Naturally, I cut all those zipties to see if the roof mechanism still worked. It was very, very stiff but proved semi-functional (the zipties appeared to be an attempt to keep a faulty latch mechanism from letting the roof pop open at speed). The roof assembly weighs a lot, though you could spend an extra $3,000 to get a power-actuation system from NCE. This cab must have been extremely noisy and buffety with the top down at speed, but so what? Convertibles are cool. Mechanically, it's an ordinary Touring Edition with a Neon's 2.4-liter four-cylinder making 150 horsepower. You could get a PT Cruiser with a five-speed manual transmission, and many did, but this one has the extra-cost automatic. Watch a roundabout foil a driver fleeing from the cops

Roundabouts aren't just improving traffic flow and confusing the elderly, the circular intersections are helping to fight crime now as well. A Michigan scofflaw fleeing from police was thrown for a loop last week when he entered a newly-built roundabout at 90 miles per hour and flipped his car. According to WXYZ, on the evening of August 18 a police officer in Marysville, Michigan attempted to stop a tan Chrysler Concorde traveling north on Range Road with expired tags. At first, the driver of the Chrysler seemed to comply and activated his turn signal. Then, with no warning, he sped off in an attempt to escape the officer. "They proceeded northbound on Range Road, through Marysville, and entered Port Huron Township approximately 90 to 100 mph," said Marysville Police Sergeant John Stover. The chase was cut short in dramatic fashion after about four miles when the Chrysler approached the intersection of Range and Griswald to discover that it had recently been turned into a roundabout. Dashcam footage from the pursuing MPD cruiser show the fleeing driver hit the brakes coming into the roundabout, but it did him little good. The rear end of the car stepped out and bumped over the curb surrounding the traffic island. The car flipped on its side, slid into the center of the island and came to rest on its roof. The driver and his passenger – Jeffery Sharp and Nichols Belkiewicz – both have sizable rap sheets and Belkiewicz has an outstanding warrant. Thankfully no one was injured in the crash, but both men are facing numerous charges including eluding, driving with a suspended license, and firearms charges.
