GM seeks appeals court ruling to continue legal fight with Fiat Chrysler

DETROIT — General Motors on Friday asked a U.S. appeals court to allow it to continue pursuing its civil racketeering suit against rival Fiat Chrysler Automobiles, rejecting a lower court judge's belittling of the complaint. The automaker's filing with the Sixth Circuit Court of Appeals comes less than a week after U.S. District Court Judge Paul Borman called GM's suit against Fiat Chrysler a "waste of time and resources" at a time when both automakers should be focused on surviving the coronavirus pandemic. Borman ordered GM Chief Executive Mary Barra and Fiat Chrysler CEO Mike Manley to meet by July 1 to negotiate a resolution. "As we have said from the date this lawsuit was filed, it is meritless," FCA said on Friday. "FCA will continue to defend itself vigorously and pursue all available remedies in response to GM's groundless lawsuit. We stand ready to comply with Judge Borman's order," it added. In its motion, GM asked the appeals court to throw out Borman's order and reassign the case to a different district court judge. It called Borman's order "unprecedented" and "a profound abuse" of judicial power. GM sued Fiat Chrysler last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. Fiat Chrysler is under investigation by the U.S. Justice Department as part of a wide-ranging probe of UAW corruption. GM's accusations came as Fiat Chrysler and French automaker Peugeot were in the early stages of preparing for a merger. Fiat Chrysler has said the suit was aimed at disrupting that deal. GM has said the suit has nothing to do with the merger. In a statement, GM rejected Borman's characterization of the suit as a "distraction" and defended its decision to press the case. "We filed a lawsuit against FCA for the same reason the U.S. Department of Justice continues to investigate the company: former FCA executives admitted they conspired to use bribes to gain labor benefits, concessions and advantages. Fiat Chrysler working on an inline-six to replace the Pentastar V6?

Get out your Skeptics Hat for this one and keep it close by. Allpar cites "reliable sources" to write that Fiat Chrysler appears to be working on a new inline-six engine to be slotted into company products around the globe. The purported engine would be based on the 2.0-liter Global Medium Engine inline-four. Allpar first reported on the potential development in February 2017 and has filed a few updates since then, one citing "internal communications referring to a GME T6" — the "T" meaning turbocharged. It's said that some engineers have changed their online resumes to reflect their focus on the new motor. Apparently, FCA tried adding forced induction to the Pentastar V6 but didn't like the results. The new direction then turned toward a "compact straight-six." In at least one guise, the GME I-6 would come in at just under three liters in order to escape taxes on engines 3.0-liters and above in certain European markets; the 2.0-liter four-cylinder has an actual displacement of 1.995 liters. The present V6 Pentastar comes in 3.2-liter and 3.6-liter guises; a turbocharged 3.0-liter straight-six should be able to replace both as far as output. Hooking up to the company's eTorque system used on the 3.6-liter Pentastar and 5.7-liter Hemi would make things even more punchy. With the trend in truck engine downsizing, it wouldn't be crazy to see such an engine head straight to Ram. The four-cylinder GME unit serves in the Alfa Romeo Giulia and Stelvio, and Jeep Cherokee, Wrangler, and Grand Commander. The big Alfa Romeos and full-size Jeep and Ram models shouldn't have any problem with a longer inline engine. Maserati, which doesn't use the Pentastar engine, could be a candidate as well should it choose to step away from its Ferrari-developed engine cred. Speaking of Ferrari, the Italian brand is working up a new V6 based, in its words, on "a very, very particular architecture." It isn't clear where it will go or if one of the other Italian brands will get access to it, but the Allpar piece says the Ferrari V6 will be based on the core GME architecture for Maserati. Chrysler gave up its last inline-six 11 years ago when the 4.0-liter I-6 retired alongside the JK-series Jeep Wrangler. The engine format is back in vogue, and its reincarnations have received good reviews. But inline-sixes are generally longer, hence FCA's focus on a compact unit, and that could limit the purported engine's placement options.

To grease the skids for Stellantis, PSA offers to boost Toyota's fortunes

BRUSSELS/MILAN — Peugeot maker PSA has offered to boost Japanese rival Toyota to try to address EU antitrust concerns about its plan to create the world's fourth-biggest carmaker, to be called Stellantis, by merging with Fiat Chrysler, people familiar with the matter said on Friday. PSA has offered to increase the production capacity for Toyota in their van joint venture, one of the sources said. Another source said the French company would sell the vans at close to cost. PSA makes vans for Toyota in its Sevelnord plant in northern France. The van collaboration started in 2012. PSA submitted its offer to the European Commission earlier on Friday, three months after the EU enforcer opened a full-scale investigation into the deal with FCA on concerns that it would hurt competition in small vans in 14 EU countries and Britain. "As of now, the transaction has obtained merger clearance in 14 jurisdictions. As previously stated, closing of the transaction is expected to occur in the first quarter of 2021," PSA and FCA said in a joint statement. The Commission, which temporarily halted its investigation into the deal in July while waiting for the companies to provide requested data, did not set a deadline for its decision. "The deadline is still suspended. This procedure in merger investigations is activated if the parties fail to provide, in a timely fashion, an important piece of information that the Commission has requested from them," the EU executive said.
