Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit

A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. FCA profits surge in second quarter

Fiat Chrysler Automobiles gave the cash register a beating in the second quarter, improving its net profit to 333 million euros ($364M US), which is a 263-percent jump over its reported Q1 profit of 92 million euros ($108M US). At the same time, FCA improved its global profit margin to 7.7 percent. Compared year-over-year, in Q2 2014 FCA reported net profit of 197 million euros making this year's Q2 a 69-percent increase, and profit margins a year ago were 4.9 percent. The two big factors for this increase are strong NAFTA sales and Jeep. In the US alone, Jeep sold 222,940 units in Q2 this year, a jump of almost 20 percent over the same period last year. Revenue in the NAFTA region totaled $18.8 billion, adjusted earnings before interest and taxes were $1.45 billion, both of those numbers more than doubling compared to 2014. The vastly better numbers come on marginally more global sales, 1,181,000 units sold in Q2 2014, 1,193,000 units sold in the same span this year. In the US, FCA began charging dealers one-percent more for vehicles to up the margins, a move that helped boost its US margin from 4.1 percent a year ago to 5.8 percent the first half of this year. The company is holding steady on its guidance of global deliveries at 4.8 million and its net profit guidance at $1.1 to $1.3 billion. It has increased its adjusted outlook for the year to $120.5 billion in revenue, and EBIT to "over $4.93 billion." Marchionne says electric Maserati may debut by 2019

Ask Sergio Marchionne's opinion on the prospects of making a profit on producing electric-vehicle versions of Fiats or Chryslers, and he's likely to shoot the concept down. Bring that price point up into Maserati range, though? That apparently may be in the works, according to Bloomberg News. The famously EV-averse Marchionne says the company may start work on an electric vehicle for its hoped-for Maserati Alfieri model. Additionally, a hybrid version of the Maserati Levante SUV may also be developed during the next few years. The EV may be available by 2019, while the hybrid may start sales shortly thereafter. Meanwhile, Fiat may also be working on an electric city car, which would be its first in Europe. The key, of course, is the price point. The Maserati brand means that a new EV may be a legitimate competitor to Tesla Motors because such a badge could approach the $100,000 threshold where the Tesla competes. Marchionne has long professed that it's nearly impossible to make money on electric vehicles. Earlier this month, Marchionne, speaking with UK's Car magazine, suggested that Tesla Motors is the best example of this theory, because, for all the demand for and growth of the California-based company, Tesla has never made an annual profit. And while the Fiat 500e electric vehicle has been feted for its style and performance, Marchionne has always insisted that the model was produced strictly to comply with California's zero-emissions policy, and that the company loses about $10,000 on each 500e it sells.
