Federal judge orders Barra and Manley to try to resolve GM racketeering lawsuit

DETROIT — A federal judge in Detroit on Tuesday ordered the chief executives of automakers General Motors and Fiat Chrysler Automobiles to meet by July 1 to try to resolve GM's racketeering lawsuit. U.S. District Court Judge Paul Borman called on GM CEO Mary Barra and FCA CEO Mike Manley to meet in person to try to resolve a case that could drag on for years. "What a waste of time and resources now and for the years to come in this mega-litigation if these automotive leaders and their large teams of lawyers are required to focus significant time-consuming efforts to pursue this nuclear-option lawsuit if it goes forward," Borman said at the end of a hearing during which FCA asked the judge to dismiss GM's lawsuit. Borman said instead, the companies need to focus on building cars and keeping people employed at a time when the coronavirus has hurt the U.S. economy and the country is also dealing with issues of racial injustice after the death of George Floyd, a Black man whose death in police custody in Minneapolis triggered worldwide protests. GM filed the racketeering lawsuit against FCA last November, alleging its rival bribed United Auto Workers (UAW) union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. GM is seeking "substantial damages" that one analyst said could total at least $6 billion. Barra and Manley should meet, taking into account social distancing to keep them safe, to "explore and indeed reach a sensible resolution," Borman said in the hearing, which was broadcast online. It is common for judges to order parties to try to resolve disputes out of court. But it is unusual that the chief executives of two big companies be instructed to meet face-to-face, not just to settle their differences but also to serve a greater good. A GM spokesman said the No. 1 U.S. automaker has a strong case and "we look forward to constructive dialogue with FCA consistent with the courtÂ’s order.” FCA had no immediate comment. Borman said he wanted to hear from Barra and Manley personally at noon on July 1 to provide him with results from their discussion. Marchionne completed Fiat-Chrysler deal from a Florida beach

Sergio Marchionne is the CEO of Fiat, which as you may have heard, has finally worked up a deal to finish acquiring the Chrysler Group after months of bargaining with the United Auto Workers and its VEBA healthcare trust, which owned just over 40 percent of the American brand. Where was Marchionne when the deal was finally hammered out? Well, not tucked away in a frigid Detroit board room until the wee hours of the morning.
Nope, one of the largest deals in automotive history was reportedly hammered out on the beach - at the home of a banker, in the Florida resort town of Vero Beach. Marchionne traveled to the home of Alain Lebec, a senior managing director at Brock Capital LLC, one of the advisory companies for the VEBA fund, where both sides met to make final arrangements in the $4.35-billion exchange. The location of the final deal, though, is nearly as remarkable as the pace with which it came about.
According to anonymous sources pinned down by Automotive News Europe, before the meeting, the two sides were meeting in Detroit as recently as December 19, which is where Fiat made one of its final revised offers. Naturally, the VEBA made a counter offer, which led Marchionne to initiate the Vero Beach meeting.

Weekly Recap: Ferrari pens a provocative F1 car of the future

Scuderia Ferrari unveiled its vision of the future for Formula One this week, revealing sketches of a sleek, muscular racecar. Called the Concept F1, Ferrari is showcasing the design to start a conversation about the next generation of Formula One cars and spur interest in the sport, which has been maligned for its unattractive racecars in recent years. The Concept F1 was penned by the company's in-house studio, Centro Stile Ferrari, with input from its aerodynamics department. Though the sketches look futuristic, the company says the design could be executed without changing F1 regulations. From its beginning, Ferrari's racecars have had both form and function, winning on the track and turning heads with everything from the 250 Testa Rossa, 330 P3, Michael Schumacher's single-seaters from the early 2000s and many others. That lineage led the Scuderia's leaders to survey the paddock, wring their hands and come up with the Concept F1. As Ferrari said on its website: "Our challenge was to create something that was – to put it short – better looking." It's a philosophy that was implemented for this season's car, the SF15-T. While not groundbreaking in appearance, Ferrari cleaned up the design, particularly up front, and the racecar now has a more attractive nose that delivers better aerodynamics. It's more of the same in back, where a tighter design creates more downforce. "This year's car is certainly an awful lot better looking than last year's car," Ferrari technical director James Allison said in a video on the Scuderia's website. The updates come as Ferrari, and all F1 teams, get a better handle on the extensive 2014 rule changes that brought back turbocharged engines and altered the aerodynamic regulations for the series. Less dramatic changes also are going into effect this year. Ferrari, which is coming off a disappointing fourth-place finish in the World Championship, is obviously looking to the future. Appearances have always mattered for the red cars. We'll see if they bring the Scuderia success this season and beyond.
