Judge refuses to reconsider GM lawsuit against Fiat Chrysler

A federal judge in Detroit said Friday that he will not reconsider his July dismissal of General Motors’ racketeering lawsuit against Fiat Chrysler Automobiles. U.S. District Judge Paul Borman wrote in an opinion that new evidence presented by GM regarding bribes and foreign bank accounts “is too speculative to warrant reopening” the case. Borman also ruled that the earlier dismissal of the case was not done in legal error. GM alleged that FCA used foreign bank accounts to pay bribes to former United Auto Workers Presidents Dennis Williams and Ron Gettelfinger, as well as Vice President Joe Ashton. It also alleges that money was paid to GM employees including Al Iacobelli, a former FCA labor negotiator who was hired and later released by GM. GM said the payments were made so the officials would saddle GM with more than $1 billion in additional labor costs. “Even if the affidavits establish that these foreign bank accounts exist, that fact does not rise to the inference advanced by GM, that FCA was more-than-likely using the bank accounts to bribe UAW officials,” BormanÂ’s order stated. GM said Friday that it would appeal BormanÂ’s ruling to the Sixth Circuit Court of Appeals. “TodayÂ’s decision is disappointing, as the corruption in this case is proven given the many guilty pleas from the ongoing federal investigation,” GM said in a statement. “GMÂ’s suit will continue — we will not accept corruption.” FCA lawyers wrote in court documents that allegations it bribed union officials are “preposterous” and read like a script from a “third-rate spy movie.” Gettelfinger denied the allegations in a statement and said he had no foreign accounts. WilliamsÂ’ California home was raided by federal agents but he has not been charged. Iacobelli, who is awaiting sentencing in the federal corruption probe, also denied the claims. “Judge BormanÂ’s ruling this morning once again confirms what we have said from the beginning — that GMÂ’s lawsuit is meritless and its attempt to submit an amended complaint under the guise of asking the court to change its mind was nothing more than a baseless attempt to smear a competitor that is winning in the marketplace,” FCA said Friday in a statement. I'm senior editor Greg Migliore and this is your Autoblog Minute Weekly Recap. A UAW strike of FCA was avoided thanks to a zero-hour tentative agreement reached this week. Worker concerns that were renegotiated in the new [00:00:30] deal include adjustments to the two-tier wage scale, health care costs, and production outsourcing. Now check-in with Autoblog as we update our reports on this evolving story. Shooting began on Amazon Prime's new automotive show starring the former Top Gear crew. That's Jeremy Clarkson, Richard Hammond, and James May. Now Clarkson threw out a tweet from day one of filming on location at Algarve Motor Park in Portugal. The picture features the show's [00:01:00] three stars and crew posing with the holy trinity of hyper cars. That's a McLaren P1, a Ferrari LaFerrari, and a Porsche 918 Spyder. This Prime show is being called Gear Knobs though the name is unofficial. Now if a tweet is any indication of what we can expect, who cares what it's called this is gonna be awesome. (Eds Note: Clarkson tweeted Friday that the show will not be called Gear Knobs.) Toyota predicts drivers could be obsolete on highways as early as 2020, with technology dubbed the Toyota Highway Teammate or THT. Toyota is using a modified [00:01:30] Lexus GS to show what this is capable of. THT is already able to create a driverless freeway car that's capable of changing lanes, making passes and taking curves. Plus, it can keep safe distances from other vehicles. Junkyard Gem: 1986 Chrysler Fifth Avenue

Chrysler started putting the New Yorker name on its top-end luxury dreadnaughts all the way back in the early 1940s. When it came time to pitch an even more exclusive New Yorker, what street did Chrysler choose for its name in 1979? Exactly. The Fifth Avenues started out as Plymouth Gran Fury siblings, then switched to the smaller M-Body Dodge Diplomat platform for the 1982-1989 model years. Here's a padded-landau-roof-equipped '86 Fifth Avenue, spotted in a San Francisco Bay Area self-service wrecking yard. Though the Fifth Avenue started life as a option package for the New Yorker, Chrysler ditched the New Yorker badging on these cars after the 1983 model year (while applying it, confusingly, to the Chrysler-badged front-wheel-drive E-Body). Perhaps this was due to certain Chrysler-demographic-terrifying developments in New York-based popular culture around that time. 1970s styling touches were still going strong in mid-1980s Detroit, and this car has lots of fake wood and button-tufted vinyl inside, with this stainless-trimmed padded landau roof outside. Mechanically speaking, it's a Dodge Diplomat, complete with 140-horsepower 318-cubic-inch (5.2 liter) V8, rear-wheel-drive, and three-speed automatic transmission. The Diplomat was a sturdy and reliable machine, but the $14,910 Fifth Avenue sticker price was a lot to pay for a Diplomat with some extra gingerbread, especially when the Diplomat listed at $10,086. The Diplomat was a very popular choice for American law-enforcement duties during the 1980s, and the chase scene from Short Time shows a slightly exaggerated depiction of its tough construction. It's a shame that the filmmakers couldn't find a way to use a Fifth Avenue instead.
