GM cites evidence of offshore accounts, wants FCA racketeering lawsuit revived

General Motors on Monday asked a U.S. federal judge to reinstate a racketeering lawsuit against Fiat Chrysler Automobiles NV (FCA), saying it has new information on foreign accounts used in an alleged bribery scheme involving its smaller rival and union leaders. In its filing to U.S. District Judge Paul Borman, GM says the scheme, which it alleges occurred between FCA executives and former United Auto Workers (UAW) leaders, "is much broader and deeper than previously suspected or revealed as it involved FCA Group apparently using various accounts in foreign countries ... to control corrupt individuals by compensating and corrupting those centrally involved in the scheme to harm GM." Last month, Borman threw out the racketeering lawsuit, saying the No. 1 U.S. automaker's alleged injuries were not caused by FCA's alleged violations. GM alleged FCA bribed UAW officials over many years to corrupt the bargaining process and gain advantages that cost GM billions of dollars. GM was seeking "substantial damages" that one analyst said could have totaled at least $6 billion. "These new facts warrant amending the court's prior judgment, so we are respectfully asking the court to reinstate the case," GM said in a statement. "FCA will continue to defend itself vigorously and pursue all available remedies in response to GM's attempts to resurrect this groundless lawsuit," FCA said in a statement. In affidavits accompanying GM's filing, attorneys for the automaker said "reliable information concerning the existence of foreign bank accounts" used in the alleged scheme had only come to light recently. "The UAW is unaware of any allegations regarding illicit off-shore accounts as claimed," by GM, the UAW said in a statement. "If GM actually has substantive information supporting its allegations, we ask that they provide it to us so we can take all appropriate actions." FCA's shifter fiasco proves novel gear selectors are a bad idea

What's wrong with PRNDL? Why are automakers trying to overly complicate the simple task of selecting gears? If there's any lesson to learn from the recent news that NHTSA is investigating 853,000 Fiat Chrysler vehicles over its problematic gear selectors, it's that the trend of fancy shifters needs to stop. Now. Last year, NHTSA opened an investigation into Jeep Grand Cherokee models, and has now expanded this probe to include the 2012-14 Chrysler 300 and Dodge Charger. The problem? The shifter – assembled by ZF – is confusing for many drivers. "Testing ... indicates that operation of the (electronic) shifter is not intuitive and provides poor tactile and visual feedback to the driver, increasing the potential for unintended gear selection," a NHTSA document states. More than 100 crashes and over a dozen injuries are linked to this problem, according to The Detroit Free Press. To us, the problem isn't just limited to FCA. These unnecessarily novel gear selectors are spreading like wildfire across the industry. Honda and Acura use a weird pushbutton setup. Lincolns have buttons on the dashboard. Jaguar's shifter electronically raises out of the center console. Mercedes uses a stalk with up-for-Reverse, down-for-Drive, push-for-Neutral arrangement. And what the hell is BMW thinking with its M cars? FCA has since abandoned the confusing shifters in question. The 300, Charger, and Grand Cherokee now use the rotary shift dial that's quickly proliferating across the company's brands. Simplistic gear selectors might not be sexy, but no one ever complained about not being able to find the right gear in a Hyundai Sonata. What's most interesting is that this NHTSA investigation could push FCA – and possibly other automakers – to redesign vehicle functions that otherwise operate as designed. Just because most people will never have a problem putting a Dodge Charger in Reverse doesn't mean there isn't a flaw with the design. But perhaps a more simplistic solution – good ol' PRNDL – would have prevented these issues from the start. Car Club USA heads to the Buckeye State for some high-octane drag racing at the Chrysler Power Classic. And for these amateur drag racers, nothing but Mopar muscle will do. "I would say Mopar is kind of a way of life," says Larry Augenstine. "Some people get addicted to lemonade, or beer, [or] drugs. Well, I'm Mopars." Larry drives a 1968 Plymouth Barracuda with a 426 Hemi motor that once belonged to local racing legend Ray Christian. He's joined at the track by Mark Ipsen of the Midwest Nostalgia Pro Stock Association. Mark runs a 1979 AMC Concord with a modified 401 block V8 that he claims has dynoed at just under 1,000 horsepower. The biggest threat to any day on track is Mother Nature, who cast a threatening shadow over National Trail Raceway for much of the event. When the clouds and rain subsided, our cameras captured the grounds crew in action with blowers, torches, and a sticky compound that's sprayed the entire length of the track.
