Judge refuses to reconsider GM lawsuit against Fiat Chrysler

A federal judge in Detroit said Friday that he will not reconsider his July dismissal of General Motors’ racketeering lawsuit against Fiat Chrysler Automobiles. U.S. District Judge Paul Borman wrote in an opinion that new evidence presented by GM regarding bribes and foreign bank accounts “is too speculative to warrant reopening” the case. Borman also ruled that the earlier dismissal of the case was not done in legal error. GM alleged that FCA used foreign bank accounts to pay bribes to former United Auto Workers Presidents Dennis Williams and Ron Gettelfinger, as well as Vice President Joe Ashton. It also alleges that money was paid to GM employees including Al Iacobelli, a former FCA labor negotiator who was hired and later released by GM. GM said the payments were made so the officials would saddle GM with more than $1 billion in additional labor costs. “Even if the affidavits establish that these foreign bank accounts exist, that fact does not rise to the inference advanced by GM, that FCA was more-than-likely using the bank accounts to bribe UAW officials,” BormanÂ’s order stated. GM said Friday that it would appeal BormanÂ’s ruling to the Sixth Circuit Court of Appeals. “TodayÂ’s decision is disappointing, as the corruption in this case is proven given the many guilty pleas from the ongoing federal investigation,” GM said in a statement. “GMÂ’s suit will continue — we will not accept corruption.” FCA lawyers wrote in court documents that allegations it bribed union officials are “preposterous” and read like a script from a “third-rate spy movie.” Gettelfinger denied the allegations in a statement and said he had no foreign accounts. WilliamsÂ’ California home was raided by federal agents but he has not been charged. Iacobelli, who is awaiting sentencing in the federal corruption probe, also denied the claims. “Judge BormanÂ’s ruling this morning once again confirms what we have said from the beginning — that GMÂ’s lawsuit is meritless and its attempt to submit an amended complaint under the guise of asking the court to change its mind was nothing more than a baseless attempt to smear a competitor that is winning in the marketplace,” FCA said Friday in a statement. Mopar teases a big Hemi crate engine for SEMA

Mopar has released a new video teaser hinting at the release of a large and powerful crate Hemi engine at SEMA later this month in Las Vegas. The video functions like a lesson on symbolism in an English lit class. It opens with smoke and settles on a pair of backlit, large-clawed paw prints that look to be feline in origin. Then we hear earth-shaking pounding sounds of something larger than the paw prints that stomps over them. Then cue an overhead shot of what looks to be a vintage-model Dodge Charger and its growly Hemi engine entering the frame and then gunning the engine. Mopar already offers three crate Hemi V8 engines, topped by the 6.2-liter supercharged Hellcat, good for 707 horsepower and 650 pound-feet of torque, found in the Dodge Charger SRT Hellcat and marketed for pre-1976 classic muscle cars. So promising that "Something big is coming" is really saying something. Could it be a crate version of the 808-hp Hemi 6.2 that was found in the Dodge Demon, which was rated at 840 hp on racing fuel? Or is it something different? Curiously, Mopar says its reveal is planned for Tuesday, Oct. 30 at the odd time of 4:26 p.m. Could that time be a reference to the 426 Hemi — and specifically the Generation III 426 Hemi "Elephant" that Chrysler made several years ago? That technically qualifies as "bigger," and it would also align with both the muscle car-era Charger and round, earth-shaking footprints shown in the video. Time will prove whether we were right. Volkswagen is not cool with a Fiat Chrysler merger

Volkswagen CEO Matthias Mueller shot down Fiat Chrysler CEO Sergio Marchionne's overtures for a merger in blunt fashion this week. Mueller told Reuters at the Geneva Motor Show, "We are not ready for talks about anything ... we have other problems. I haven't seen Marchionne for months." The unusually candid – and icy – response from one chief executive to another comes after Marchionne similarly pursued General Motors (again) this week. The FCA boss suggested GM might be looking for a new European partner as it prepares to unload its troubled Opel and Vauxhall divisions to PSA. A GM spokesman told USA Today that the company is not interested. Marchionne has been openly suggesting a GM merger since at least 2015, despite GM never reciprocating interest. VW's "other problems," as Mueller notes, include legal proceedings, fines, recalls, and other issues related to its long-running diesel scandal. Marchionne has long sought industry consolidation, arguing that automakers don't get a proper return on their investments in technologies, some of which are relatively similar. He's suggested sharing chassis and powertrain components could be a benefit to the collective auto sector. Skeptics argue FCA, which is smaller than GM, VW, Toyota, and others, needs a partner to survive, while its rivals already have the necessary scale to remain competitive. Related Video:
