FCA under investigation for fraud by FBI, SEC, and DOJ

The US Justice Department is currently in the initial stages of investigating Fiat Chrysler Automobiles for fraud, according to two anonymous sources that spoke with Bloomberg. According to the unnamed sources, prosecutors are examining whether FCA violated US securities laws. As part of a coordinated investigation into FCA's sales reporting practices, investigators from the Federal Bureau of Investigation and the Securities and Exchange Commission visited the automaker's field staff in their offices and homes earlier this month, reports Automotive News. According to an anonymous source that spoke to Automotive News, federal staff attorneys visited FCA's US headquarters in Auburn Hills, MI on July 11. The unnamed source told the outlet that employees were advised to seek counsel before speaking with investigators. Investigators also visited the automaker's offices in Dallas, California, and Orlando, the unnamed source told Automotive News. The investigation comes after FCA claimed it had recorded the best month of sales in the US in the automaker's history in December with a total of 217,527 vehicles sold, reports Bloomberg. The claim now seems untrustworthy. According to a previous report from Automotive News, a Chicago-based dealership group filed a lawsuit against FCA earlier this year. The suit accused the automaker of paying dealers to fake new-vehicle sales. At the time, the automaker claimed the allegations were baseless and had no merit. After the lawsuit, FCA started to add an extended disclaimed at the end of its monthly sales reports, according to Automotive News. In a statement, FCA claimed that the automaker is cooperating with the SEC investigation and pointed out that it records "revenues based on shipments to dealers and customers, not on reported vehicle unit sales to end customers." FCA recalls over 200k Jeep Cherokees for windshield wiper static

Fiat Chrysler Automobiles is issuing a recall for over 200,000 versions of the 2014 Jeep Cherokee due to a problem with static buildup disabling the windshield wipers. FCA has identified 158,671 units in the United States. Another 18,366 vehicles are estimated to be affected in Canada, a further 3,582 in Mexico, and 26,049 outside of North America. The problem, according to the first statement below, results from static building up if the wipers are operated in dry conditions. The static could mess with the wipers' control module, rendering them disabled. To fix the problem, dealers will be instructed to install a ground strap to the module. In parallel, FCA is also offering incentives to the owners of certain trucks that were subject to recall but for which remedies were not immediately available. To encourage those owners to bring their older vehicles in for the required service, the automaker will disperse $100 prepaid cards for use at their discretion. The program is offered to owners of certain model year Jeep Grand Cherokee, Jeep Liberty, Chrysler Aspen, and Dodge Durango sport-utility vehicles, as well as certain Dodge Dakota and Ram trucks. Owners of the affected Grand Cherokees will have the option instead to take a $1,000 consideration toward the purchase of a new vehicle or for parts and service. STATEMENT: CONTROL MODULE August 31, 2015 , Auburn Hills, Mich. - FCA US LLC is recalling an estimated 158,671 SUVs in the U.S. to help protect their control modules from static buildup that may potentially disable the vehicles' windshield wipers. An investigation by FCA US discovered static buildup may occur if the vehicles' windshield wipers are activated during dry conditions. Significant static buildup may affect a control module that powers the wipers. The Company is unaware of any related injuries or accidents. Affected are model-year 2014 Jeep Cherokee SUVs. An estimated 18,366 vehicles will be recalled in Canada, as will an estimated 3,582 in Mexico and 26,049 outside the NAFTA region. Dealers will install a ground strap to the control module to eliminate the potential for static buildup. Customers will be advised when they may schedule service, which will be performed at no cost.

US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.
