Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit

A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. Marchionne blames design 'dummies' for poor Chrysler 200 reception

I like the new Chrysler 200. In fact, we have one in the office this week, and every time I see it outside, I think to myself, "That's a really good looking car." But truly good automotive design allows form to perfectly blend with function, and that's where the 200 falls short – so short, in fact, that Chrysler's midsize sedan has yet to earn a full recommendation from the folks at Consumer Reports. The problem? That slick roof design. During an interview at the Detroit Auto Show this month, Fiat-Chrysler CEO Sergio Marchionne said the 200's rear roofline compromised ingress and egress from the rear seats, and that's why CR can't fully recommend it. "The 200 failed because somebody thought that the rear-seat entry point inside the 200 – which is our fault, by the way – is not up to snuff," Marchionne said to Automotive News. Marchionne went on to say that FCA's designers copied the roofline of the Hyundai Sonata, which "has the same problem." He continued, "We didn't copy the car, we copied the entry point to the rear seat. Dummies. I acknowledge it." Harsh words, but Marchionne isn't alone in his sentiments. FCA design boss Ralph Gilles tweeted today, "He is right, we might have gone too aggressively after aero. Which we achieved as it is best in class. No free lunch." So yes, the 200 looks good. But following this incident, perhaps a redesign will ditch that sloping roof for something that's a bit more functional. Related Video:

At the same time, Jay's shop is working on just a simple restoration of his 1969 Lamborghini Espada (pictured), and at the other side of the building, the team is rebuilding a wood-bodied 1914 Detroit Electric from scratch. He eventually plans to slot a more modern electric drivetrain into it. If bikes are more your interest, there's a freshly completed Brough Superior just waiting for a ride, and if American models are your thing, a Ford Bronco is getting a Coyote V8 installed into it. You have some very specific tastes if you can't watch this clip and start wishing at least one of these vehicles could be in your own garage. Other than the personal projects his mechanics are working on in the shop, Jay gets to have them all, plus plenty more.
