FCA under investigation for fraud by FBI, SEC, and DOJ

The US Justice Department is currently in the initial stages of investigating Fiat Chrysler Automobiles for fraud, according to two anonymous sources that spoke with Bloomberg. According to the unnamed sources, prosecutors are examining whether FCA violated US securities laws. As part of a coordinated investigation into FCA's sales reporting practices, investigators from the Federal Bureau of Investigation and the Securities and Exchange Commission visited the automaker's field staff in their offices and homes earlier this month, reports Automotive News. According to an anonymous source that spoke to Automotive News, federal staff attorneys visited FCA's US headquarters in Auburn Hills, MI on July 11. The unnamed source told the outlet that employees were advised to seek counsel before speaking with investigators. Investigators also visited the automaker's offices in Dallas, California, and Orlando, the unnamed source told Automotive News. The investigation comes after FCA claimed it had recorded the best month of sales in the US in the automaker's history in December with a total of 217,527 vehicles sold, reports Bloomberg. The claim now seems untrustworthy. According to a previous report from Automotive News, a Chicago-based dealership group filed a lawsuit against FCA earlier this year. The suit accused the automaker of paying dealers to fake new-vehicle sales. At the time, the automaker claimed the allegations were baseless and had no merit. After the lawsuit, FCA started to add an extended disclaimed at the end of its monthly sales reports, according to Automotive News. In a statement, FCA claimed that the automaker is cooperating with the SEC investigation and pointed out that it records "revenues based on shipments to dealers and customers, not on reported vehicle unit sales to end customers." Federal judge throws out GM's racketeering lawsuit against Fiat Chrysler

  DETROIT — A federal judge on Wednesday threw out a racketeering lawsuit General Motors had filed against smaller rival Fiat Chrysler Automobiles, saying the No. 1 U.S. automaker's alleged injuries were not caused by FCA's alleged violations. GM officials said in statement they "strongly disagree" with the order by U.S. District Court Judge Paul Borman, whom the automaker had sought to have removed from the case, and would appeal. "There is more than enough evidence from the guilty pleas of former FCA executives to conclude that the company engaged in racketeering, our complaint was timely and showed in detail how their multi-million dollar bribes caused direct harm to GM," GM said in a statement. The Detroit company added that Borman's decision "would let wrongdoers off the hook." GM filed the racketeering lawsuit against FCA last November, alleging its rival bribed United Auto Workers (UAW) union officials over many years to corrupt the bargaining process and gain advantages, costing GM billions of dollars. GM was seeking "substantial damages" that one analyst said could have totaled at least $6 billion. FCA had called the case meritless and asked Borman to dismiss it. On Wednesday, Borman dismissed the lawsuit "with prejudice," meaning GM cannot refile the complaint. "The direct victims of defendants' alleged bribery scheme are FCA's workers," Borman wrote of FCA. "GM's high labor costs were not an injury proximately caused by FCA's bribes, and any competitive injury that GM suffered as a result of FCA's advantage in labor costs is an indirect injury." "The dismissal of GM's complaint with prejudice earlier today vindicates our position," FCA said in a statement. On Monday, the Sixth U.S. Circuit Court of Appeals denied GM's petition to remove Borman from the case, but said the two automakers' chief executives didn't have to meet to try to settle the case as Borman had ordered. 2019 Chrysler Pacifica and Dodge Grand Caravan 35th Anniversary Editions debut in Chicago

Just ahead of the 2019 Chicago Auto Show, FCA revealed a pair of special editions to commemorate the 35th anniversary of the original Dodge Caravan and Plymouth Voyager. The 2019 Chrysler Pacifica, Pacifica Hybrid and Dodge Grand Caravan 35th Anniversary Edition models will make their full debut this week sporting special badging and paint. Since the original 1984 models debuted, Chrysler has sold more than 14.6 million minivans around the world. Chrysler introduced the original Caravan and Voyager in late 1983. The pair shared much with Lee Iacocca's storied K-platform. K-based models such as the Dodge Omni and Plymouth Horizon helped turn around Chrysler's fortunes in the early '80s. Likewise, the Caravan and Voyager were a huge success and provided the template for modern minivans including the Honda Odyssey and Toyota Sienna. The Pacifica and Grand Caravan 35th Anniversary Editions both come with an all-black interior featuring Cranberry Wine accent stitching on the seats, steering wheel, door trim, instrument panel bezels and door handles. There's also a 35th Anniversary logo on the floor mats plus badges on the grille and liftgate. The package is available on Pacifica Touring L, Touring L Plus and Limited trims, including hybrid models. An optional S package (blacked out trim) can be added to any 35th anniversary Pacifica. The anniversary package can be added to Grand Caravan SE and SXT models. The anniversary package will be available sometime this summer.
