Fiat Chrysler to pay $40 million fine for inflating sales numbers

DETROIT — Fiat Chrysler is paying $40 million to settle with U.S. securities regulators who say the automaker misled investors by overstating its monthly sales numbers over a five-year period. The Italian-American company inflated sales by paying dealers to report fake numbers from 2012 to 2016, the U.S. Securities and Exchange Commission alleged in a complaint. Fiat Chrysler agreed to pay the civil penalty and to stop violating anti-fraud, reporting and internal accounting control regulations, the SEC said Friday in a statement. The automaker did not admit or deny the agency's allegations, the statement said. "This case underscores the need for companies to truthfully disclose their key performance indicators," Antonia Chion, associate director in the SEC's Enforcement Division, said in the statement. She noted that the new vehicle sales figures give investors insight into the demand for an automaker's products, a key to assessing the company's performance. Fiat Chrysler said it has reviewed and refined its sales reporting procedures. It said the payment will not have a large impact on its financial statements. The agency said the automaker boasted about a streak of year-over-year sales increases into 2016, when the streak actually was broken in September of 2013. When the company disclosed the sales scheme in 2016, it said that it had a "reserve" stock of cars that had been shipped to big fleet buyers such as rental car companies but not recorded as sales. The SEC said employees called this database of actual but unreported sales the "cookie jar." The company dipped into those sales to stop the streak from ending, or when it would have missed other sales targets. Fiat Chrysler said it now records sales as soon as vehicles are shipped to customers. It has also take steps to ensure that a sale is immediately subtracted from its books when it finds out the deal was scuttled because the buyer backed out or couldn't get financing. The SEC probe is another in a long string of legal troubles for Fiat Chrysler. It also faces federal investigations into illegal payments to union officials through a training center, and a criminal probe into allegations that its diesel-powered trucks were programmed to cheat on emissions tests. When it comes to a belief in the viability of electric vehicles, you can put automotive folks like Nissan's Carlos Ghosn and Tesla Motors' Elon Musk on one side of the proverbial wall and Fiat Chrysler Chief Technology Officer Harald Wester on the other. Because while the two former executives are staking much of their companies' respective future on plug-in electric drivetrain technology, Wester sees no such future in it at all, according to an interview in Motor Trend. Oh, sure, the Fiat Chrysler technology chief does give the idea of an electrified powertrain some quarter, saying he sees standard hybrids as a solution for the "intermediate" future in addressing both higher gas prices and need to meet progressively more stringent European greenhouse gas-emissions standards. But Wester, who also oversees Fiat Chrysler's Alfa Romeo and Maserati brands, ultimately views hydrogen fuel-cell technology as the way to go for advanced powertrains and minimal emissions. As for battery-electric vehicles? Wester pretty much shoots them, citing everything from a typical EV battery's weight to the challenge of finding electric recharging stations to the fact that much of the electricity needed for those cars is produced via CO2-emitting sources. He forgot to say anything about the CO2 required to bring gasoline or hydrogen to market. Wester's "bah humbug" is actually pretty consistent with the company's party line. 2017 North American Car, Truck, and Utility of the Year entries announced

Over 40 vehicles will compete for the 2017 North American Car, Truck, and Utility of the Year awards. If that name looks a little strange, it's because the competition added a third category. In years past, pickup trucks, crossovers, SUVs, commercial vans, and minivans competed for the same award. That's why there were occasionally weird comparisons, like last year's competition between the Volvo XC90 and Nissan Titan XD. The new format separates pickups and commercial vans into the truck contest and CUVs, SUVs, and minivans into the utility competition. A complete list of eligible vehicles is below, but here are a few highlights. For one, the entire list of entries has a luxurious lean. Of the 43 vehicles, nearly half of them are from premium brands. There are two eligible Bentleys – the Bentayga and Mulsanne – the Rolls-Royce Dawn, Jaguar F-Pace, Audi Q7, and the Mercedes-Benz GLS-, E-, and S-Class Maybach. The performance ranks are lofty, too, with the Audi R8, Acura NSX, Alfa Romeo Giulia, Mercedes SL- and SLC-Class, Porsche 718, and F-150 Raptor. The mainstream entries are just as comprehensive. From the Chrysler Pacifica to the Chevrolet Cruze to the Fiat 124 Spider to the Mitsubishi Mirage, NACTOY has covered an enormous price range with this year's contestants.
