Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit
Tue, Jul 7 2020A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. FCA acknowledges this with the just-revealed, limited-edition Mopar 2019 Dodge Challenger celebrating its factory-backed performance parts and accessories straight from the its own in-house parts division. For 10 years, Challenger owners have benefited from upgrades directly from Chrysler’s Mopar division. This has been a big deal because tuning a car often required aftermarket parts, which could jeopardize factory warranties. But with upgrades directly from original equipment manufacturers, such a risk was eliminated. “Over the last decade, weÂ’ve customized an impressive group of vehicles with exclusive Mopar performance parts and accessories that our enthusiast customers crave,” said Mark Bosanac, head of Mopar Service in a statement. “This year weÂ’re commemorating our tenth Mopar build with another unique and collectible Dodge Challenger, which continues to be the modern muscle car every bit as beloved today as the first-generation vehicle was 50 years ago.” The 2019 Mopar Dodge Challenger starts life as R/T Scat Pack model. Under the hood sits a 392-cubic inch (6.4-liter) Hemi V-8 with 485 horsepower and 475 pound-feet of torque with the choice of a six-speed manual or an eight-speed automatic. But Mopar sweetens the deal by adding a performance cold-air intake, strut tower braces to improve structural rigidity and handling, as well as strut caps and braces painted in silver for eye candy whenever the hood is popped. ItÂ’s only available in two hues, Pitch Black or White Knuckle, and comes with a variety of bespoke interior and exterior upgrades. They include special Mopar Shakedown graphics and blue striping from the front fascia all the way back to the rear decklid spoiler. Completing the look is a set of 20x9-inch forged aluminum wheels wrapped in Goodyear P245/45ZR20 performance tires and the optional shaker hood package made standard. Samsung Galaxy Note 7 disaster endangers FCA's Magneti Marelli sale
Thu, Oct 13 2016Samsung's financial and public relations positions are going up faster than one of the company's Galaxy Note 7 smartphones, and that's bad news for Fiat Chrysler. FCA was in talks with the South Korean tech giant to sell all or a portion of Magneti Marelli, the enormous Italian parts supplier. The deal, estimated to be in the $3 billion range, was a big part of FCA CEO Sergio Marchionne's five-year plan to slash his company's ˆ5.5 billion ($6.07 billion at today's rates) debt. But Samsung's flaming phones may have stalled the deal, Automotive News reports. Samsung was hoping to acquire all or part of Magneti to gain access to its lighting, in-car entertainment, and telematics business, all in a bid to reduce its reliance on occasionally explosive consumer electronics, AN's sources report. This week alone, Samsung permanently ended production of the Note 7 and began recalling millions of devices, sending out flame-proof return boxes so owners can ship the device back in relative safety. The disaster has already caused Samsung to slash its third-quarter operating profit by $2.3 billion, and is leading the company to divert its attention away from big, blockbuster deals, people "who asked not to be identified because the negotiations are private" told AN. According to the same sources, the two sides haven't even agreed on a valuation for Magneti Marelli. Neither company was willing to comment on the potential sale.
