Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit

A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. NHTSA closes book on Jeep 'trailer hitch' recall after all

After much debating and hand-wringing, the National Highway Traffic Safety Administration now says it has "no reservations" with Chrysler's plan to recall certain Jeep Liberty and Grand Cherokee models over concerns that their fuel tanks, which are located behind the rear axle, could rupture or leak in the event of a rear impact. The longstanding argument between the two entities saw Chrysler openly defy the Feds after a request to recall 2.7 million units back in June.
Chrysler's "voluntary campaign" will instead see it recall 1.56-million 1993-2004 model year Grand Cherokee SUVs, along with 2002-2007 Liberty models. Affected vehicles will get a trailer hitch installed free of charge, which Chrysler says will provide an additional degree of protection for the fuel tanks in the event of a crash. Jeeps with Mopar-branded hitches or hitches that were installed at the factory aren't affected by this recall.
Chrysler's argument throughout this battle has been that the Jeeps in question are no more susceptible to fires than comparable vehicles from the same time period, a position that NHTSA has seemingly arrived at as well. "Those vehicles performed at a rate similar to their peers. That is the keystone analysis as to whether something poses an unreasonable risk to safety," said outgoing NHTSA boss David Strickland during an interview with the The Associated Press.

Add Sergio Marchionne's insistence that it's impossible to make money on electric vehicle production to death and taxes among things we can all count on. The Fiat Chrysler Automobiles CEO, speaking in an interview with UK's Car Magazine, implied that Tesla Motors was "the iPhone of cars." The metaphor may have been mixed, as iPhones make plenty of cash for Apple, whereas Tesla has never made an annual profit from its electric vehicles. But the implication was that automakers should stick to what they know, and they don't know smartphones. Forget any upcoming presidential debates, we're waiting for one between Marchionne and Tesla chief Elon Musk. As for the development of autonomous-driving features? Those are another story, says Marchionne, and an area where he's far more in line with Musk. That's because the technology required to make a car safely accelerate, brake, and steer on its own is far cheaper than making a car with an electric drivetrain that offers similar range and performance to a car with an internal combustion engine, he says. As opposed to electrification, Fiat Chrysler has been going the route of modifying conventional powertrains via wringing out more power out of progressively smaller engines, and mating them with eight- and nine-speed transmissions. As for EVs, credit Marchionne for his consistency. Fiat Chrysler has been selling the Fiat 500e since 2013. That year, Wards Auto named the 500e motor to its 10 Best Engines list, while the 500e won Road & Track's 2013 award for best electric car. Still, Marchionne has long said that Fiat only makes the vehicle for to satisfy zero-emissions vehicle mandates in California, and that the company loses as much as $10,000 for every 500e that it sells.
