GM cites evidence of offshore accounts, wants FCA racketeering lawsuit revived

General Motors on Monday asked a U.S. federal judge to reinstate a racketeering lawsuit against Fiat Chrysler Automobiles NV (FCA), saying it has new information on foreign accounts used in an alleged bribery scheme involving its smaller rival and union leaders. In its filing to U.S. District Judge Paul Borman, GM says the scheme, which it alleges occurred between FCA executives and former United Auto Workers (UAW) leaders, "is much broader and deeper than previously suspected or revealed as it involved FCA Group apparently using various accounts in foreign countries ... to control corrupt individuals by compensating and corrupting those centrally involved in the scheme to harm GM." Last month, Borman threw out the racketeering lawsuit, saying the No. 1 U.S. automaker's alleged injuries were not caused by FCA's alleged violations. GM alleged FCA bribed UAW officials over many years to corrupt the bargaining process and gain advantages that cost GM billions of dollars. GM was seeking "substantial damages" that one analyst said could have totaled at least $6 billion. "These new facts warrant amending the court's prior judgment, so we are respectfully asking the court to reinstate the case," GM said in a statement. "FCA will continue to defend itself vigorously and pursue all available remedies in response to GM's attempts to resurrect this groundless lawsuit," FCA said in a statement. In affidavits accompanying GM's filing, attorneys for the automaker said "reliable information concerning the existence of foreign bank accounts" used in the alleged scheme had only come to light recently. "The UAW is unaware of any allegations regarding illicit off-shore accounts as claimed," by GM, the UAW said in a statement. "If GM actually has substantive information supporting its allegations, we ask that they provide it to us so we can take all appropriate actions." Strike looms for FCA workers as soon as Wednesday night

A strike is on the very near horizon for at least some United Auto Workers members at FCA US. On October 6, the union sent a letter to the automaker that officially announced the termination of its agreements with the company as of 11:59 PM on Wednesday, October 7. Assuming that a deal or extension hasn't happened by that time, workers could hit the picket line. While neither side is talking much publicly, it does appear that negotiations are still underway. In a very brief statement, the automaker simply says: "FCA US confirms that it has received strike notification from the UAW. The Company continues to work with the UAW in a constructive manner to reach a new agreement." The UAW seems equally receptive, and it says in a post on Facebook: "Negotiations with FCA continue. Your bargaining team is hard at work and we will continue to post updates when there is more to report." If a strike happens, it could put a serious financial burden on FCA US. Economist Sean McAlinden from the Center for Automotive Research estimates the cost at as much as $40 million per week, according to Reuters. The union hasn't clarified at this time whether all of its workers with the automaker would stop working or if the picket lines would only be at specific plants. The first tentative agreement posted to UAW members working with FCA US utterly failed in voting. Raises and a healthcare co-op would have been among the new benefits. However, the employees were upset that the proposed deal retained a two-tier wage structure, and they also didn't like the lack of details about rumors of major production changes.

SRT Viper plant idled over slow sales [UPDATE]

The SRT Viper is taking an extended production break later this spring while the factory copes with low demand and gears up for the 2015 model year. Chrysler will idle the Conner Avenue Assembly Plant from April 14 to June 23, and 91 employees there will be laid off during that time. Sales have been slow so far this year, with just 91 Vipers sold in the first two months of 2014 (591 were sold all last year), according to The Detroit News. According to Chrysler, this is all part of the plan for the Viper. The automaker says that the Connor Avenue factory was meant to fluctuate in this way because it only builds one vehicle, and the sports coupe was never meant to be a mass-production vehicle. The company claims that idling the plant will allow it to manage showroom inventories. "Customer and dealer demand for the SRT Viper continues at expected levels," said Chrysler spokesperson Dianna Gutierrez to The Detroit News. SRT hasn't revealed what changes are planned for the 2015 model. This isn't the first time we've heard of the Viper's weak demand. As of October 2013, SRT had hoped to build around 2,000 examples, but only about 1,000 had been made. At that point, officials then revealed production would likely be scaled back. We've contacted the Chrysler for further information, and we'll update this post if and when we hear back. UPDATE: Chrysler has passed along this official statement regarding the plant idling: Chrysler Group confirms that its Conner Avenue Assembly Plant will be down, beginning the week of April 14. Production will resume the week of June 23. Ninety-one UAW-represented employees will be laid off during this time.
