Appeals court rejects GM's bid to remove judge from Fiat Chrysler lawsuit

A U.S. appeals court on Monday denied General Motors' petition to remove a lower court judge from its racketeering lawsuit against Fiat Chrysler Automobiles, but said the companies' heads need not meet to settle the issue. The Sixth U.S. Circuit Court of Appeals said U.S. District Judge Paul Borman abused his discretion by requiring GM CEO Mary Barra and FCA's head, Mike Manley, to meet face-to-face for reasons unrelated to the case, and without taking into account the risks of travel during the COVID-19 pandemic. The district judge's order for the parties to report back to the court in only eight days was also unwarranted, the appeals court said. Borman in June ordered Barra and Manley to meet by July 1, and later amended his order to allow other officials in their place. "We do not mean to say, however, that the district judge may not order a pretrial settlement conference and/or mediation in the normal course," the appeals court said in a filing. The court in June stayed Borman's order requiring officials from the two firms to resolve the lawsuit, and on Monday rejected GM's request for a new judge to oversee the case, saying Borman's desire for a quick settlement was "not so extreme" that he needed to be replaced. GM said in a statement it was grateful that the court had quickly reviewed and granted its petition for a writ of mandamus, that is, setting aside the requirement to meet. However, the company did not comment on the rejection of its request to reassign the case to another judge. GM sued FCA last year, accusing the Italian-American company's executives of bribing United Auto Workers union officials to secure labor agreements that put GM at a disadvantage. Fiat Chrysler Automobiles (FCA) has approved the use of E15 in its 2016 model year vehicles. The Renewable Fuels Association is pleased with the automaker's choice to cover the higher ethanol blend in its warranty statements, describing it as a positive signal for the future growth of E15. "FCA's decision to join GM and Ford provides clear evidence that the tide on E15 has turned," says RFA President and CEO Bob Dinneen. Skoda's head of purchasing, Dieter Seemann, discusses sourcing EV components in a new interview. He says the biggest challenge is seeking out future suppliers for electric motor and connected vehicle components. "We have to really understand what happens in this business to identify the right partners to have in five to eight years from now," says Seemann. "Many of these are suppliers completely new to us." Nissan is helping the European Commission develop a pedestrian alert system for electric vehicles. Called Electric Vehicle Alert for Detection and Emergency Response (eVADER), the project aims to develop technology that provides audible cues to alert pedestrians to oncoming vehicles without contributing to noise pollution. Nissan created a system for the Leaf that uses a camera to recognize pedestrians and cyclists and direct a sound in their direction. This work will help the EU shape its laws moving forward. The hybrid uses Nissan's All Mode 4x4-i all-wheel-drive system, and is equipped with a host of safety technology. Fiat ups Chrysler stake by 3.3%, inches closer to full control

Fiat is one step closer to completing a merger with Chrysler after exercising an option to acquire an additional 3.3 percent of the Auburn Hills-based automaker today. Automotive News reports that Fiat now controls 68.49-percent of Chrysler, which is up almost 10 percent since we last heard news of this deal back in February when Fiat talking to various banks to raise more capital in order to complete the acquisition.
The article says that Fiat is still able to increase its stake in Chrysler up to 75 percent over the next 12 months, but it sounds like CEO Sergio Marchinonne would rather purchase the remaining shares from VEBA - the retiree benefits trust - sooner rather than later. Unfortunately, the two sides still seem far from an agreement on a fair price for the rest of Chrysler, as Fiat has them valued at $4.2 billion compared to the $10.3 billion estimate from the unions that currently own the remaining stake in Chrysler.
