GM recalls 200k Hummer H3s for fire risk

An issue with fires erupting in some Hummers has prompted General Motors and the National Highway Traffic Safety Administration to issue a recall for nearly 200,000 vehicles around the world. The bulk of them are in the United States. According to the first statement (below) obtained by Autoblog from GM, the issue stems from the HVAC system in Hummer H3 models. The connector module for the blower motor has, in certain cases, overheated, melted the surrounding plastic, and started a fire. 42 such cases have been reported, including three instances of occupants citing minor burns. GM confirms that two of those three cases lead to the vehicle being destroyed in the fire, but states that no crashes or fatalities have resulted. The issue affects 196,379 examples of the 2006-10 H3 wagon and the 2009-10 H3T pickup, with 164,993 estimated to be in the United States. In order to fix the issue, dealers are being instructed to replace the relevant parts of the connector and harness. In a second, unrelated campaign, GM is also calling in 50,731 Chevy Spark and Sonic small cars – 45,785 of them in the US – due to a software glitch. In those affected vehicles fitted with the base radio and OnStar system, the audio system may not be able to switch out of turn-by-turn direction mode, causing the display to go blank and all sound to mute – including key safety warnings. In addition, the system may not switch off, draining the battery. GM states that no crashes, injuries, or fatalities have resulted from this issue, and all that dealers will need to do in this case is reflash the software. GM is aware of three reported minor burns and 42 fires but no crashes or fatalities related to this condition. Buick Encore, Chevy Trax earn Top Safety Pick from IIHS [w/video]

The Buick Encore has been a massive sales success practically from the moment it debuted, and Buick recently decided to increase production to keep up with demand for the premium compact crossover. The Insurance Institute for Highway Safety recently put one to the test again, and the Encore earned a Top Safety Pick award. It's the first model from the brand to score the nod since 2013, according to the IIHS, and the rating also carries over to the 2015 Chevrolet Trax. The 2015 Encore scored a Good rating in all of the IIHS' evaluations, including the 40-mile-per-hour, small overlap front crash test. That was a big improvement over the previous model the institute tested, which scored a Poor result in the overlap test. In the first test, about 13 inches of the lower door hinge pillar came into the passenger compartment, and the steering wheel airbag moved too far to protect the dummy's head. Improvements for the latest model year showed six inches of intrusion this time, and the airbags caught the dummy's head well. The dummy's sensors also indicated a low risk of injury. The two CUVs missed out on the full Top Safety Pick+ because the IIHS scored the Encore as only having a basic front crash prevention system, and there was no such equipment for the Trax. To earn the highest mark, models need at least an advanced rating by the institute for this technology. The Buick Encore's newly introduced, lower-priced twin, the Chevrolet Trax, also qualifies for the honor. The Encore's award follows improvements to the SUV's structure for better small overlap front protection. The 2015 model earns a good rating in the small overlap test. In contrast, the 2013-14 Encore rated poor in the test. The driver's space was seriously compromised with intrusion measuring as much as 13 inches at the lower door hinge pillar. The dummy's head barely contacted the front airbag before sliding off the left side, as the steering column moved to the right. The side curtain airbag deployed too late and didn't have sufficient forward coverage to protect the head. In the latest test, the driver space was maintained reasonably well, with maximum intrusion of 6 inches at the door hinge pillar and instrument panel. The dummy's movement was well-controlled.

GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.
