GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy updates Silverado HD with new towing equipment

Enamored by the updated Chevy Silverado released just the other day, but need something a little more heavy duty? Chevy isn't going to keep you around waiting for long, as it has now revealed a new Silverado HD as well. While the new Silverado 1500-series has been distinguished over the outgoing version principally by its revised styling, the updated Silverado HD is more about its enhanced equipment. It's got a new Digital Steering Assist system (on some models) designed to enable easier and safer towing. There's a new gooseneck/5th-wheel trailer prep package that enables Chevy's new heavy duty truck to tow as much as 23,200 pounds. And the interior equipment is augmented as well by a new MyLink system with seven- or available eight-inch display, Apple CarPlay and Android Auto capability, wireless phone charging and more. Buyers will be able to choose between two versions (2500HD and 3500HD), four trim levels, three cab sizes, two cargo box lengths, and numerous powertrain and drivetrain configurations for a staggering array of combinations. There'll also be several special editions and packages, like the Z71 for off-road use and Custom Sport Edition for a sleeker look, as well as chassis cab and CNG versions. How real is the Chevy Bolt EV and will it really cost $30,000?

"This is us bragging that we can do this kind of car." That's how Michael Simcoe, GM's executive director for NA exteriors, described the Chevy Bolt EV concept, which made a surprise appearance at the Detroit Auto Show today. While there was talk of a 2017 production debut, this is for sure a concept vehicle. But that means the ideas behind the vehicle are perhaps more important than the details. For example, no one is talking about what size battery might appear in a production Bolt, but Simcoe would talk about how rapid progress in battery improvements made it possible for GM to make the bold Bolt declaration that promises 200 miles and a price tag of around $30,000 (after incentives). But if the Bolt makes it to market, it won't be until 2017 (as rumored) or later, is it really fair to promote the car as being available with a federal tax credit? For one thing, credits for plug-in vehicles may change in the next few years, but if the laws stay the same, each manufacturer is limited to 200,000 vehicles before the credits start to decline. GM is justifiably proud that it's sold over 70,000 Volts thus far, but with a new model coming out later this year and a few years to go until the Bolt potentially arrives, GM could be pushing right up against that 200,000 limit when the Bolt goes on sale. But Volt executive chief engineer Pam Fletcher told AutoblogGreen that, "We're just trying to take some of the confusion out." "Think about talking to the average consumer," she said. "First, going through the explanation of how the federal tax credit was set up, how it's being used and so on. [In the industry, we] have the luxury of understanding the nuances of that regulation, but right now people who aren't in the marketplace, they don't have the luxury of all that. It's already hard to communicate the details so we gave them data in a way that is what they're used to seeing." There was one question that drove the two-year Bolt gestation and design period, Simcoe said: What does a better battery offer a vehicle designer? "We've got a number of spaces we play in for powertrain technology and obviously electrification is one of them," he said. "With Volt 1 and then the Spark EV, with that development and batteries getting better for us, we started doing some practical packaging to deliver a vehicle which was not the traditional aero form which you see around electric vehicles.
