GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

Detroit Three's lucrative pickup war intensifies as Ram makes big gains

DETROIT — The battle for profits from sales of large pickup trucks is intensifying among the Detroit Three automakers as sales of small cars in the United States shrivel. For decades Ford has had the single best-selling truck brand in its F-Series trucks. General Motors' Chevrolet brand was a solid No. 2, and Fiat Chrysler Automobiles' Ram was a distant third. Now, that hierarchy may be in flux. Sales figures for December and the fourth quarter released on Thursday show Ram tied with GM's Chevy for the No. 2 spot, as sales of the redesigned Ram pickup surged, fueled in part by demand for an optional 12-inch (30.48 cm) dashboard screen. Chevy not long ago held second place to Ford by a wide margin. "It's been that way forever, and we wouldn't have it any other way." On Wall Street, investors give electric car leader Tesla a higher valuation than any of the Detroit automakers. But in the nation's heartland, big pickups remain far more popular and profitable than any electric car — and most other consumer vehicles of any kind. Large pickups generate at least $17,000 a vehicle in pretax profit for GM, the company has indicated in disclosures to investors. By contrast, many Detroit Three sedans are so unprofitable, their manufacturers have decided not to build them anymore. 'Hotly contested' Sustaining sales and pricing in the large-pickup segment will be critical in a year when most forecasters expect overall U.S. car and light truck sales to fall. Ford's U.S. sales chief, Mark LaNeve, on Thursday called the F Series "the backbone of our franchise" during a conference call, and added the "segment will continue to be strong, but hotly contested" in 2019. Automakers are banking on pickup truck sales to stay strong even if U.S. interest rates continue to rise. Rising interest rates translate into higher monthly car payments and are expected to deter some buyers in 2019. GM has said 27 percent of Chevrolet and GMC trucks — which can haul trailers by day and substitute for a luxury sedan by night — sell for more than $55,000.

Next Chevrolet Malibu to have 'groundbreaking,' 'passionate' design

In our First Drive of the Chevrolet Malibu after its redesign in 2013 we wrote, "Chevy has quickly worked up a host of changes for its ever-important midsize sedan, and will be launching this 'there, we fixed it' 2014 Malibu like it's an all-new product." Still, no one cared. The Malibu has been mentioned in eight posts this year, all but two of them dealt with recalls, and one of those two was about a 2011 Malibu university science project. It came up in precisely zero posts from November 2013 to March 2014. That's why, according to a report in Automotive News, Chevrolet honchos are "hustling" to have a new Malibu ready in a year. Mark Reuss, General Motors' head of global product development, said it will have "groundbreaking design" and "groundbreaking technology," and asked investors who were showed a picture of it, "When is the last time you saw a [midsize] car this distinctive and this dramatic from General Motors?" Doubling down on the bullishness, Reuss said, "We've got our act together here on the midsize-car segment." Then, throwing every last chip on the pile, global design head Ed Welburn said the next Malibu's design will "make a significant statement" with "a very passionate design." Based on the number of comments Malibu posts get, we figure a fair few number of you would love for this to be the case; yet this is a lot of braggadocio to slather on a car that probably hasn't made "a significant statement" since Elton John had a number one record with Honky Chateau. Alongside the Cruze, GM figures the pair will bring in an extra $800 million in variable profit in 2016. Which, in case it ends up being another 'butterface,' isn't bad for a silver lining.
