Train derailment leaves Jeep, GMC, Chevy pickups damaged in Nevada

An unfortunate train derailment is causing some inevitable delays for pickup truck customers west of Nevada. Yesterday morning, 33 train cars derailed in Lincoln County, and the cargo that was being transported consisted of new Jeep Gladiators and Wranglers along with Chevrolet Silverados and GMC Sierras, judging from the photos released by the Lincoln County Sheriff’s Office. The train derailment also caused the adjacent road to be closed, and local law enforcement recommends the area is to be avoided as long as it takes to clean it all up. In the photos, damaged Jeeps and other trucks sit either on their wheels or shiny-side-down as the incident is being assessed. Available information says there were thankfully no personal injuries, but itÂ’s not likely any of these trucks will end up in customer hands, even with a significant discount. Pre-registration transport damage, significant or not, has often resulted in scrapping complete vehicles so that manufacturers can steer clear of liability issues. Hooniverse.com, which also reported on the incident, notes a couple of interesting things. Firstly, the upended Gladiator seems to have a pretty sturdy support structure for its glasshouse, thanks to its new rollbars. Another matter is that the GM trucks, also pictured, wear discreet and temporary transport steel wheels instead of fancier items, perhaps to deter thieves eager to grab a shiny set from trucks on their way to the dealer. Still, itÂ’s a shame these vehicles could never fulfill their hauling purposes in the hands of new owners. Perhaps the manufacturers can at least use the damage for data-gathering purposes. Chevy Bolt 200-mile EV going into production near Detroit

Where there's smoke, there's fire, apparently. The rumors of the Chevy Bolt going into production have been proven correct, with an announcement this morning at the Chicago Auto Show that the 200-mile, all-electric Bolt will be built at the Orion Assembly facility near Detroit. GM didn't say exactly when the Bolt will be built, but GM North America president Alan Batey said in a statement that, "We are moving quickly because of its potential to completely shake up the status quo for electric vehicles." He's not kidding. GM is talking about a $30,000 price tag for an EV that can do twice as many electric miles as any non-Tesla mass-production EV today. Previous hints have the Bolt starting production next year for a market debut in 2017, and with all of the accuracy we've seen from these secret releases up to now, we're going to say this is probably accurate until we hear otherwise. We still have questions about the price tag, but for now we'll try to track down more information here in Chicago. The Bolt EV concept was introduced last month at the North American International Auto Show in Detroit. "The message from consumers about the Bolt EV concept was clear and unequivocal: Build it," said Batey. "We are moving quickly because of its potential to completely shake up the status quo for electric vehicles." Leveraging the industry-leading battery technology found in the Chevrolet Volt and Spark EV, the Bolt EV concept was developed as a game-changing, long-range pure electric for all 50 states, designed to offer more than a GM-estimated 200 miles of range at a target price of around $30,000. The progressively styled concept vehicle features selectable driving modes for preferred driving styles, such as daily commuting, and it was designed to support DC fast charging. "We're proud that Chevrolet has decided to produce the Bolt EV here in Michigan at the Orion Assembly facility," Gov. Rick Snyder said. "Michigan unquestionably remains the global automotive leader.

GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case.
