GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM marks 500 million vehicles

General Motors is marking a major global milestone, as 500 million vehicles have rolled off its assembly lines since the company's founding in 1908. To mark the occasion, the automaker is continuing to invest in production and offering a one-time discount to some customers. GM North America boss Alan Batey used the festivities to announce the Fairfax Assembly factory in Kansas as one of the sites earmarked for the company's $5.4 billion in upcoming investments. The plant will get $174 million of that money for new equipment and technology to build the 2016 Chevrolet Malibu. Among the upgrades will be a shake-and-rattle booth that will simulate road conditions to find squeaks. To commemorate both the production milestone and the Fairfax plant, Batey and company CEO Mary Barra also gave away a 2016 Malibu to a wounded Iraqi war veteran, and the two execs announced that in the third week in May all GM employees can share a one-time customer appreciation discount with friends to help get them into the automaker's products. Innovation on the Line: GM Manufacturing Milestones Many of General Motors' most important innovations have occurred behind the scenes, in its manufacturing facilities. Concepts such as changeover, flexible assembly, automation, computer simulation, machine vision and robotics were developed at GM. Over the decades these innovations have helped enable improvements in vehicle quality, efficiency and competitiveness. 1901: Ransom Olds' famous Curved Dash Oldsmobile, designed with simplicity, reliability and value in mind, was the first American car built in a factory designed specifically for automobiles and in standardized volume production. GM acquired Oldsmobile in 1908. 1908: Cadillac wins the Dewar Trophy, Europe's most prestigious award for precision and excellence in manufacturing, by demonstrating the auto industry's highest standards for precision and interchangeability of parts by disassembling three Cadillacs and mixing the parts randomly before reassembling and driving them before a contingent of judges. 1922: GM hires William Knudsen to lead Chevrolet's turnaround. Knudsen implements flexible mass production, which helps Chevrolet incorporate annual styling changes and take market share from Ford.

Nissan Leaf has outsold Chevy Volt by 50% so far in 2015

We know, we know. The Chevy Volt and Nissan Leaf sales numbers for mid- to late-2015 aren't all that meaningful because of the impending arrival of the next-gen Volt and the expected but not-yet-totally-confirmed debut of the second version of the Leaf. Nonetheless, tracking the sales of the first two major plug-in vehicles is something that remains interesting to us, if for nothing else that the all-electric Leaf remains slightly more popular than the plug-in hybrid Volt after all this time. If we just look at August, the numbers were basically tied in the US. Chevy sold 1,380 Volts while Nissan moved 1,393 Leafs. But when we take a 10,000-foot view, the differences starts to appear. So far in 2015, GM has sold 8,315 Chevy Volts while Nissan has sold 12,383 Leafs. That means that the Nissan has outsold the Chevy by around 50 percent (to be specific, it's 48.92 percent). Since the two vehicles went on sale in the US at roughly the same time at the end of 2010, 81,672 Volts have been sold, compared to 84,705 Leafs. That's a difference of only 3,033 vehicles, so proponents of both powertrains can hold their heads high. Looking just at last month, Volt sales were 45 percent lower compared to August 2014. So far this year, Volt sales are down 36.7 percent. The Leaf didn't fare any better. Month-to-month, Leaf sales were down 43.7 percent in August, while year-to-date, Leaf sales are down 65.3 percent.
