GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Nissan Leaf sells 1,553 in April, Volt climbs to 905

After three months in the 500 and 600 range, sales of the Chevy Volt climbed to 905 in April. That's up for the year so far – likely due to increasing discounts – but still down 41.5 percent from April 2014. As we've been saying every time the Volt turns in less-than-exciting monthly sales numbers, we suspect a large number of potential Volt buyers are waiting for the next-gen model to arrive in the second half of 2015. While the price for that car has not yet been announced, the updated tech specs show that it will probably be worth the wait for drivers who want the latest and greatest. Over on the Nissan Leaf side of things, April sales were 1,553 units this year. That's the second-best month of the year but down from the 2,088 units sold last April. After the Leaf finally climbed to the top of the cumulative best sellers list for plug-in vehicles last month, the difference between these two leaders is now 1,824 in favor of the Leaf. Nissan says that sales were influenced by the launch of its No Charge To Charge promotion in Indianapolis and Fresno, CA. This deal gives new Leaf buyers and lessees two years of no-cost quick charging in these markets. No Charge To Charge is not available in 15 US markets for (San Francisco, Sacramento, San Diego, Seattle, Portland, Nashville, Phoenix, Dallas-Ft. 2016 Chevy Colorado Duramax makes 369 lb-ft for $3,730 premium

Since announcing the new Chevrolet Colorado in late 2013, there has been absolutely no secret that the 2.8-liter Duramax diesel would wind up under the hood of the midsize pickup truck for the 2016 model year. It has been a long wait for those wanting the oil-burner, but thankfully, the anticipation is nearly at an end. Chevy is finally officially unleashing details about the four-cylinder, which churns out 181 horsepower and 369 pound-feet of torque. The diesel is available in both LT and Z71 Crew Cab trims, and there's the choice of two- or four-wheel drive. All come with a six-speed automatic gearbox with a standard automatic-locking rear differential. An electronically controlled two-speed transfer case comes on four-wheel drive models, as well. The Z82 trailering package also arrives on all of the Duramax pickups and includes an exclusive integrated trailer brake controller. The first shipment of diesels arrives at dealers this fall with a price of $3,730 on top of a comparably equipped version with the 3.6-liter V6. Customers opting for the Duramax are getting more capability from the Colorado. With a 7,700-pound tow rating on two-wheel drive examples (7,600 pounds with four-wheel drive), drivers can haul 600-700 pounds more behind the truck than its petrol V6 counterpart. Fuel economy numbers haven't been announced yet, but are expected to top the gasoline versions. The engine is also B20 bio-diesel compatible. Beyond being just a good hauler, Chevy is throwing cutting-edge tech into these models. For example, this is the company's first application of a Centrifugal Pendulum Vibration Absorber on the transmission's torque converter. The device is a dampener that cancels out torsional vibration from the engine for a more comfortable ride for occupants. There's also a driver selectable exhaust brake system that uses engine compression to help slow down the truck and reduce brake wear.
