GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Best trucks for the money in 2024, according to iSeeCars

Full-size trucks are some of the most popular vehicles on the road in the U.S., but they’ve become exceedingly expensive in some cases. That makes it even more important to choose the right full-size truck to maximize value and longevity. iSeeCars recently released its list of the best trucks for the money for 2024, ranking AmericaÂ’s full-size trucks on the cost to own over 10,000 miles. Though the Ford F-150 is the best-selling new full-size truck, it failed to break into the three best trucks for the money, landing at number four on the list. Though many are expected to last quite a while – some have lifespan estimates of more than 180,000 miles, and the Toyota TundraÂ’s average life is 226,032 miles – all of them are expensive. iSeeCars found that the average new truck purchase price is $61,353, with trucks like the GMC Sierra 1500 topping $66,000. iSeeCars ranked the trucks on their purchase price and 10,000-mile ownership costs, not on driving excitement, styling, tech, or safety. It also did not asses each truckÂ’s capabilities, such as towing and payload, but said that buyers looking to save money should only purchase one if they have “genuine truck needs.” The study looked at several vehicle types to find the best models for the money in each category. The Mitsubishi Mirage was the best car overall, returning a $1,099 10,000-mile ownership cost and a low $18,991 purchase price. There are still 6,000 first-gen Chevy Volts on dealer lots

The next-gen 2016 Chevrolet Volt looks to be a pretty fantastic vehicle with more electric driving range, better fuel economy than its predecessor, and a lower starting price. However, if you're looking for a deal, the 2015 model of the plug-in hybrid might not be a bad place to check because Chevy has a ton of them to get rid of. According to The Detroit Free Press, there are around 6,000 examples of the 2015 Volts that are still sitting on dealer lots. That might not sound like a lot, but Chevy only sold 905 of them in April and 2,779 through that month in 2015. It moved 18,805 of the PHEVs for all of 2014. Buyers are in a pretty good spot to haggle at the moment, too, with the a new Volt right around the corner. According to The Detroit Free Press based on TrueCar figures, the current average closing price for a 2015 model is $30,607 before any federal or state tax credits. You can also lease one for 39 months for $299 a month and $1,649 due at signing. In April, Chevy was reportedly offering customers 2.9-percent financing for 48 months and leases with no money down for buyers trading in a vehicle from a competitor. Of course, there's also always the option to buy a pre-owned example. Just a few months ago, prices for used Volts were reportedly as low as $13,000 at auction.
