GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy Volt sales surge with 2016 model, Nissan Leaf continues Autumn fall

The Nissan Leaf and Chevy Volt have been locked in sales combat since they arrived within a short distance of each other way back in 2010, and we continue to follow that fight closely. Though both vehicles approach driving efficiency from a different angle, they each have plugs and owners put a surprisingly similar number of electric miles on them. With the launch of its 2016 model, the Bowtie brand now appears to have the upper hand, clocking in a solidly improved performance for the month of October. According to GM's sales charts, the Chevy Volt made it into the loving embrace of 2,035 buyers last month. That's up a whopping 41 percent over the same period in 2014, and more than a 100 percent improvement from the 949-unit result in September. Now, we don't know how many of these were 2015 models and how many were the all-new 2016 edition. Dealers are, no doubt, incentivized to move the old inventory, and the latest and greatest is still only available in a limited number of states. Breaking out the sad trombones, Nissan recorded a mere 1,238 units moved in October. That's down 52.2 percent from the same month in 2014. That's also nine fewer examples than last month. Despite its recent sales travails, the Leaf still leads the calendar-year-to-date figures by a commanding 14,868 to 11,299 tally. We imagine the Japanese manufacturer is counting on an improvement in the situation once the 2016 model, with its larger, optional 30 kWh battery becomes available. 2015 Chevrolet Corvette Z06

"Corvette" has stood for American muscle, American sports car, and American supercar. In many cases, it still stands for America: liberty on the go, LS-powered freedom. There was also a time when it meant really impressive numbers that didn't equate to really impressive handling, and a not-so-nice cabin. The handling issue really turned the road-legal corner when the C5 Z06 was introduced in 2001, and by the time the super-duper ZR1 ended its run in 2010, Corvette had exorcised practically all of its dynamic demons. But when I took a seat in the 2015 Corvette Z06 on the first day of my week-long loan, I espied a few demons still squatting in the interior. When colleague Seyth Miersma drove the Z06, he wrote, "Listen, I'm not going to be the guy that dogs the Corvette for having a cheap-feeling interior, this generation has put those once-legitimate claims to rest." Well, I am going to be that guy, because I don't think those claims have been put to rest. One day Chevy will give us leather that looks and feels like leather, instead of the astonishingly thin hide that is laid directly on top of the instrument panel structure. This material was set off by white stitching, but there were no seams, just a trail of white stitches. In some places it was hard to tell where the leather ended and the plastic began; or it might all have been the same upholstery, I don't know. Five dollars of foam padding would add five thousand dollars of luxury to the cockpit. One day Corvette will have plastics that don't look so plasticky. I know General Motors can do it. And after years of thinking Corvette seats were too wide and flat, this latest Z06 is almost there. The seatbacks were nice, but the exaggerated side bolstering on the seat bottoms was too narrow and sharp. That's a personal preference, though; other drivers with thinner thighs will think differently. My complaint isn't that the interior isn't luxurious, it's that it's not luxurious enough. If Chevrolet was worried about pricing, it could add some kind of profligate package to the options list. Have some ex-Porsche people design it, call it the Teutonic Splendor Package, slap a massive price on it, and count the money. People will buy it, and no one will ever have to say again, "But the interior..." That said, this test car's cabin had every feature I wanted. The gauge cluster was bright, crisp, and readable in every shade of daylight.
