GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM extends production at Detroit factory until early 2020

General Motors Co said on Friday it had extended the production at its Detroit Hamtramck plant until January 2020, against an earlier plan to discontinue production in June this year. The No.1 U.S. automaker is revamping its operations, which include plant closures and thousands of job cuts, as it looks to boost profitability in the wake of declining U.S. auto sales. The Hamtramck plant will continue to produce the Chevrolet Impala and Cadillac CT6 sedans until early next year, the company said. "We are balancing production timing while continuing the availability of Cadillac advanced technology features currently included in the CT6-V — the Blackwing Twin-Turbo V-8 (engine) and Super Cruise (driver assistance system)," GM said. The plant has already discontinued production of the Buick LaCrosse sedan and Chevrolet Volt electric hybrid car. Detroit-based union United Auto Workers' President Gary Jones said GM's decision to continue production at the plant was a relief for the workers as well as their families. Now's the time to buy a cheap first-gen Chevy Volt

Would you fork over 18 grand and change for a new Chevrolet Volt extended-range plug-in vehicle? If so, there are some for the taking. Since the updated Volt is about ready to hit dealerships, current models have become a lot easier to afford. For some reason, it appears the best deals are in Iowa, recalling some sort of Field of Dreams-style whispering voice luring car shoppers to their first plug-in vehicle, according to EV Obsession. To wit, a couple of 2014 Volts with a sticker price in the $35,000 range are being offered for less than $26,000 in that Midwestern state. Factor in the $7,500 tax credit from the federal government, and the Volt can be had for less than the sticker price of a Toyota Prius C compact hybrid. Chevy started priming that particular pump earlier this year, though didn't appear to have a ton of success. This past spring, Chevrolet was offering some impressive lease deals on the Volt, with monthly payments dropping to less than $250. There's a reason buyers will want to wait for the second-generation Volt. The 2016 version will have a 53-mile all-electric range, up from the 38-mile range in the current version, along with 106 MPGe. Some will say that the style is improved as well, and the first-gen's touch-sensitive control panel was discarded for more buttons. Still, if you're more concerned about price than having the newest car on the lot, now's a good time to shop. And speaking of the current version, sales remain down substantially. Last month, Chevy moved 1,380 Volts, a 45-percent plunge from a year earlier. Through August, Volt sales were down 37 percent this year compared to 2014 numbers, to 8,315 units.
