GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM again delays plant that will build the Silverado EV

  General Motors Co. will again push back the planned opening of an electric pickup truck plant in suburban Detroit and has delayed a Buick plug-in amid uncertain growth in battery-powered car sales. Mary Barra, the company’s chief executive officer, told analysts Tuesday on an earnings conference call the automaker is postponing until mid-2026 the opening of its Orion Assembly factory, which will make the Chevrolet Silverado EV. This is the second delay for the plant, which was originally slated to start production in late 2024. Shares of the automaker fell 4.1% to $47.52 as of 9:39 a.m. in New York. The stock is up about 32% so far this year. The delay is a main reason why GM wonÂ’t be able to meet its previous goal of having production in place to make 1 million EVs by the end of next year. The company said they will add production as buyers show more interest in electric vehicles. “We continue to make sure we continue to scale the business to customers and where they are at,” GM Chief Financial Officer Paul Jacobson said on a call with reporters. GM reported on Tuesday a 60% jump in second quarter profit compared with a year ago, topping Wall StreetÂ’s expectations on strong demand for its traditional gas-powered trucks in the US market.

GM starting to talk seriously about 200-mile EV

We've been hearing word of a 200-mile EV from Chevrolet for a while now. First, there was General Motors then-CEO Dan Akerson hinting at a $30,000, 200-mile EV that would take the competition by surprise. Then Akerson confirmed that GM is working on a 200-mile EV in a speech in March. LG Chem, which supplies batteries to GM and other automakers, recently said it was working on batteries for EVs with a range of 200 miles. GM's head of global product development Mark Reuss just re-confirmed that there are plans for an EV with a 200-mile range, and sources have told Automotive News what that car will be. While Reuss didn't mention anything about a specific model or platform, two undisclosed sources with knowledge of GM's plans have said that an EV with a range of about 200 miles is indeed in the works, and that it will be based on the Chevrolet Sonic. The sources also gave a timeline for the car, saying it is slated for sometime in 2017. According to Reuss, the plan is for Chevy to offer a lineup of electric cars, with the 200-mile EV joining ranks of the Chevrolet Volt and the Spark EV. He didn't hint at a timeline, but if the sources are correct, we could see a Sonic EV being built within a few years. Reuss sees demand for it, too. When speaking of the Spark EV, currently only available in California and Oregon, he says that "people wish we would sell it all around the country." If he's right about that, it's not difficult to imagine people taking interest in Chevrolet's 200-mile electric car, whether or not it's a Sonic.
