GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2016 Chevy Camaro Convertible gets cleaner looks, improved refinement [UPDATE]

Now, and not at all surprisingly, the Bowtie brand is showing off the latest Camaro convertible, based on the coupe that debuted on Belle Isle in Detroit. From the beltline down, this is the same car that was so well-received last month. But above the waist, there's an all-new, fully automatic canvas roof that can be raised and lowered at speeds up to 30 miles per hour. On top of that, owners will be able to drop the roof remotely by simply pressing a button on the key. Chevy does not, however, say if this new convertible roof is lighter than last year's top. The biggest change for the Camaro convertible, though, is something we've long yearned for – a proper hard tonneau cover that deploys over the folded roof. The current muscle car's roof fabric has the unpleasant tendency to flap in the breeze. The new droptop shouldn't have that problem, and will likely boast an even cleaner top-down profile to boot. Like the hardtop, though, the Camaro convertible does benefit from the same lightweight structure, that helps trim "at least" 200 pounds of body fat. It should also make use of the same powertrain lineup, with a turbocharged four-cylinder, a 3.6-liter V6, and a 6.2-liter V8 with six-speed manuals or eight-speed automatic transmissions spanning the lineup. "From the beginning, the Camaro's architecture was developed to incorporate a convertible with uncompromised driving dynamics," Camaro chief engineer Al Oppenheiser said in the attached release. "Customers will appreciate what they don't feel: quivers, cowl shake or an under-damped chassis typically found in a four-seat convertible." Increased refinement, a cleaner look, better driving dynamics and a more usable convertible roof? We're looking forward to you 2016 Camaro convertible. Chevy claims the new car arrives in "early 2016," which means we should plan on seeing this droptop at the typically cold and snowy Detroit Auto Show. See all seven colors available on 2016 Chevy Volt

General Motors has been happy to promote the 2016 Chevy Volt in the shiny blue color. On the company's website for the car, though, we can find all seven exterior colors, thanks to the magic of digital technology. We went through the site and played around with the option picker and put together a gallery of all the colors the new Volt will be available in as well as the five interior options. For the record, the exterior colors are: Kinetic Blue Metallic, Iridescent Pearl Tricoat, Summit White, Silver Ice Metallic, Mosaic Black Metallic, Siren Red Tintcoat, Heather Grey Metallic. You'll be forgiven if you can't quite tell the difference between the Pearl and the White in these images, but both colors have been available on the 2015 model year Volt. GM spokesperson Michelle Malcho told AutoblogGreen that buyers do have a preference, with Pearl accounting for 10 percent of the sales and Summit White accounted for 17 percent. The Pearl color is a tri-coat and thus has a $995 price premium, which was likely a factor as well. The interior of the new Volt will have two cloth options (Dark Ash and Jet Black) and three leather choices (Dark Ash, Jet Black, and Jet Black/Brandy). That last one will only be available in the LTZ trim level. You can play around with the color adjuster yourself here. Kathy Sirvio, the color and design manager of the Volt design team, told AutoblogGreen that, "Kinetic Blue is a marketing name. At Design we call it 'Blew Me Away'. That is it in a nutshell. The blue color is vibrant, rich and eye catching. It may not sell at the highest volume, as we know from history whites, blacks and silvers are the dominant color sales. However, it will tell everyone who sees it on the street that here comes a new vehicle and it is expressive in all the right ways." The next-gen Volt arrives later this year with a starting price of $33,995. The powertrain upgrades will push the all-electric range to 50 miles and the gas-only fuel economy to 41 miles per gallon.
