GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Most of the US won't get 2016 Chevy Volt

Every major plug-in vehicle launch in the US has been a patchwork operation, with automakers focusing their initial efforts on targeted locations like California where they expect to sell the most units. Today, we learned that even five years into the plug-in car project, the game remains the same. According to GM, the second-gen Chevy Volt is going to be rolled out in the same manner. In fact, GM is limiting availability of the 2016 model year Volt so much that most of the US will not have access to the car at all. For 39 states, the second-gen Volt will first be available as a 2017 model year vehicle at some point in the spring of 2016. When GM announced the buying process for the new Volt, it made it clear that dealers in California would be the first to place their orders. Hybrid Cars now reports that the first deliveries will be also limited to California and 10 other states that follow the California Air Resourced Board (CARB) rules: Connecticut, Massachusetts, Maryland , Maine, New Hampshire, New Jersey, New York, Oregon, Rhode Island, and Vermont. GM spokesman Kevin Kelly told AutoblogGreen that this is all according to plan. "Chevrolet has a shortened model year for the 2016 Chevy Volt that will have a limited distribution network," he said. "The 2016 Volt will be sold in our strongest EREV markets. The 2017 Chevrolet Volt will begin production early this spring and will be available throughout the country." It appears that non-CARB state Volt customers will be able to order their Volts starting October 1, according to documents posted on Hybrid Cars, where we also learn that 2016 Volt production for California started in August, will begin in late October for the other 10 CARB states, and in early 2016 for the rest of the US. Unsurprisingly, dealers outside of the 11 CARB states have been complaining that they can't order the much-anticipated new Volt for their customers just yet. Related Video:

The Silverado 1500 gets what most would consider an early update for 2016. Just two years into this generation, the half-ton Chevy truck has been given a visual overhaul and a handful of feature upgrades. Chevy reps say they didn't wait the usual three years for a refresh because they knew the domestic competitors were planning updates of their own for 2015. We're told the fast refresh was always in the plans, and that it wasn't a response to critics (like us) saying "meh" to the new truck's design, which some felt hewed too close to the GMT900s that came before. If a Ford grille that reaches halfway into the headlights is good, a Chevy grille that cuts the units clean in two must be better. That's at least how we imagine the designers' thought process went. Those new split lights use HID projectors on lower models and full-LED tech on the upper trims, with all versions getting LED daytime running lights. LED taillights are also included on the fancier models. <p>Your browser does not support iframes.</p> Each of the eight trim levels has its own look, and the differentiation goes beyond the placement of chrome and the color of cladding. Look closely and you'll see that elements of the various grille treatments are repeated within the headlights. It's a neat touch, and proof that attention to detail is still a thing. Chevy also reshaped the hood, with sharp lines and pockets that look like they'll do a great job of collecting snow come winter. We get why a Corvette has troughs in its hood (you know where the wheels are and see through the valley to the road) but the surfacing on the Silverado's engine hat has only aesthetic benefits. On the feature front, almost all 2016 Silverado models get standard Apple CarPlay and Android Auto support; the 7.0-inch screen includes both, while the available 8.0-inch screen will add Android Auto through an update in March of 2016. The top High Country trim gets new power-articulating side steps as an option. In addition to swinging down to help you hoist yourself in through the door, the steps have a button at the rear that, when pressed, motors them down and rearward to give you a foothold at the front of the bed. Chevy also catches up to the competition with an available remote-locking tailgate. Chevy also gets further into the competitive numbers game for 2016 with expanded use of its eight-speed truck transmission.
