GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy Malibu rolls over 10 million on the odo

On the cusp on the introduction of the latest model, the Chevrolet Malibu is celebrating a major milestone with 10 million of them now on the road since the car's introduction 51 years ago. While not quite enough to rank among the best-selling vehicles of all time, the feat is impressive considering the name took over a decade off from the Chevy lineup in the '80s and '90s. The Malibu started life in 1964 as the top trim on Chevy's new, midsize model, which also included the 300 and Chevelle. Offered in a plethora of body styles, including a wagon and convertible, the Bowtie brand moved over 370,000 of them in the first year. By 1969, sales reached more than 503,000. However, the market for rear-wheel drive sedans eventually softened in the US, and the Malibu name was dropped in 1983. The moniker returned in front-wheel-drive form in 1997 and has been a part of the lineup again ever since. These days, the Malibu is obviously only available as a four-door, but the model is more efficient than ever. The larger, lighter 2016 example can get up to 37 miles per gallon highway with its 1.5-liter turbocharged four-cylinder or 47 mpg combined when the hybrid goes on sale next year. The Malibu is sold in more than 25 markets around the world. "The Chevy Malibu joins an exclusive club of vehicles that have achieved this extraordinary milestone and we acknowledge it today by honoring the common thread linking every one produced: The customer," said Alan Batey, president, global Chevrolet. "Some people are buying their very first Malibu today and others may have driven a Malibu from a different generation as their first car. It is a car that has resonated with customers for more than half a century." Chevrolet's interaction with customers has evolved since the Malibu was introduced in 1964. Back then, an owner's manual and a personal relationship with the dealer defined conventional customer service.

Consumer Reports criticizes small turbo engines for misleading performance, fuel economy claims [w/video]

Consumer Reports has taken aim at at small-displacement, forced-induction engines, saying the powerplants don't manage to deliver on automaker fuel economy claims. Manufacturers have long held that smaller, turbocharged engines pack all power of their larger displacement cousins with significantly better fuel economy, but the research organization says that despite scoring high EPA economy numbers, the engines are no better than conventional drivetrains in both categories. Jake Fisher, director of automotive testing for Consumer Reports, says the forced induction options "are often slower and less fuel efficient than larger four and six-cylinder engines."
Specifically, CR calls out the new Ford Fusion equipped with the automaker's Ecoboost 1.6-liter four-cylinder engine. The institute's researchers found the engine, which is a $795 option over the base 2.5-liter four-cylinder, fails to match competitors in acceleration and served up 25 miles per gallon in testing, putting the sedan dead last among other midsize options.
The Chevrolet Cruze, Hyundai Sonata Turbo and Ford Escape 2.0T all got dinged for the same troubles, though Consumer Reports has found the turbo 2.0-liter four-cylinder in the BMW 328i does deliver on its promises.
