GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2022 Chevy Tahoe, Suburban and GMC Yukon get updated transmission

General Motors' full-sized SUVs have slipped in one more change before the year turns. GM Authority reports that the 2022 Chevrolet Tahoe and Suburban, and the 2022 GMC Yukon and Yukon XL equipped with gas V8 engines, will pick up a revised ten-speed automatic transmission. The new unit carries RPO code MHS, and Chevrolet communications rep Catherine Scales told GMA the updated gearbox "allows our manufacturing and dealer teams to more easily align the specific calibration needed for the transmission and can enable OTA updates in the future." It seems GM wants to make it easier to update the transmission's tuning and calibration in the future with the automaker's networked Vehicle Intelligence Platform/Global B electronic architecture. The 10-speed auto comes bolted to the 5.3-liter V8 and the 6.2-liter V8. The 3.0-liter inline-six Duramax diesel continues with the 10-speed automatic already in use. To recap the other changes for the full-sizers, we'll start with the 2022 Tahoe and Suburban, which get a new 12.3-inch digital instrument display to replace the former 8-inch unit and physical gauges. Navigation will be standard equipment displayed on the 10.2-inch infotainment touchscreen on all trims barring the base LS. Lane-keeping assist and parking sensors are also now standard, while reverse automatic braking is added to the Enhanced Display and Alert package on the top trims. Finally, the 6.2-liter V8 option is expanded to the Z71, RST and Premier trim levels, but it requires selecting one or more packages on the Z71 and RST. Moving onto the 2022 Yukon, availability of the 6.2-liter V8 expands to the AT4 trim, and the big V8 comes with a shiny pair of exhaust finishers. Redwood Metallic paint joins the exterior color palette, more wheel options are on offer, and illuminated sill plates can gussy up the rocker panels . An Enhanced Trailering Technology Package adds 13 cameras with the option for an interior accessory camera for those with enclosed haulers. On the safety side, expect reverse automatic braking to join the list of available driver assistance features. Inside, the Yukon welcomes the 12.3-inch digital cluster, the Yukon Denali welcomes the power sliding console as a standard feature instead of a $350 option.  Related Video:

Viewers of the Winter Olymics (at least in some markets) recently saw a TV ad in between the skating and the skiing that made no mention of the environmental benefits or freedom from the power of Big Oil that electric vehicles provide. No, this one was based on pure survival instinct. In the video, a father is driving down a highway, perhaps through the Mojave Desert. His young son is sitting in the Volt's backseat and asks what happens when the EV's battery runs out. "We'll have to cross that burning desert with snakes and cactus until we make it back to civilization," the dad tells his son as they pass the skeleton of a fallen bull.
