GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy bringing Spark RS Concept to SEMA

Well, the SEMA mess has well and truly begun. Every year, an increasing number of automakers flock to the Las Vegas auto show, bringing accessories and concept vehicles that are both awesome as well as occasionally questionable. Chevy will bring an RS concept of the new Spark to SEMA, signaling that its styling package will be applied to the brand's smallest vehicle in the near future. We can expect the usual stuff in a production Spark RS – larger wheels, a slightly sportier cabin, a more aggressive body kit, and a small drop in ride height – but for the concept, Chevy wasn't restrained by things like budget. The front splitter, and sill extensions, foglight surrounds, and rear bumper insert are all finished in carbon fiber. The 17-inch alloys are apparently inspired by the Corvette Z06's Z07 package, while the Dark Liquid Switchblade Silver paint is broken up only by a driver's-side stripe. The company is also using SEMA to show its new Red Line accessories, features both concept and production parts for the Trax, Camaro, Malibu, Colorado, and Sierra. Every vehicle gets Enhanced Silver Metallic paint, a charcoal finish on the roof, satin graphite/red graphics, black/red badge kits, and aside from the Colorado, tinted lamps. Individual mods for the Trax include relatively simple tweaks, including new 18-inch wheels, blacked-out bowtie badges, a lowered ride height, and custom badging. It's a similar story on the Malibu, except that its 19-inch wheels are a smidge larger, and its lowered ride height is the result of a concept kit. The first concept based on the new Camaro opts for 20-inch wheels, while adding a few more performance items. The ride height has been lowered, there's a new air intake system, and an upgraded brake package. Chevy has also replaced the front upper and lower grilles inserts with red accents. On the pickup side of the coin, the Colorado gets 18-inch wheels, new intake and exhaust systems, Goodyear Wrangler Fortitude tires, and flared wheelarches. The Silverado gets similar intake and exhaust upgrades, as well as the largest wheels of them all, with 22s at all four corners. The full-size truck also gets a Brembo brake package, while every vehicle, aside from the Camaro, gets Thule roof-mounted accessories. 2016 Chevrolet Camaro: Notes from the reveal

The 2016 Chevrolet Camaro debuted Saturday evening in Detroit at an enthusiast-oriented event near the city's IndyCar course. While the big news was the Camaro's 200-pound weight loss, tighter chassis, and a snorting new V8, plenty of other morsels of Camaro info came out. Here's some of the more interesting stuff we heard. • The 2.0-liter inline four-cylinder is the first turbocharged engine in a Camaro. • The LT1 borrowed from the Corvette Stingray marks the third time a Camaro has used an engine with that badge. It was previously used in 1970-72 (Z/28), 1993-97 (Z/28), and 1996-97 (SS). • The Camaro was revealed in a tent before nearly 1,000 enthusiasts, General Motors executives (including CEO Mary Barra) and mere feet from the Grand Prix course where IndyCars will run in two weeks. • Chevy hopes to continue to attract new customers with the Camaro and said 63 percent of the fifth-generation buyers were new to the brand. • GM product boss Mark Reuss neatly summed up the Camaro's handling character. "It's wicked fast and extremely nimble." • Reuss on the design goal: make it "look like a car for tomorrow instead of a car from yesterday." • Reuss' first car was a 1967 Camaro, and he's reiterated his passion for the car. "People want to be seen in a Camaro, and that never goes away." • Chevy North America president Alan Batey said he plans to line up a red Camaro as soon as the order bank opens. We assume he'll have early access to that. • Though the appearance is similar, the sixth generation of the Camaro appears a little sleeker and is more aerodynamic thanks to 350 hours in the wind tunnel. Only two parts, the SS badge and the rear bow-tie emblem, are carryover. • Al Oppenheiser, the Camaro's chief engineer, said most of the options (except Magnetic Ride Control, which is SS exclusive), will be offered on the inline four. The engine will be capable of propelling the Camaro to a sprint to 60 miles per hour in well under six seconds. "We don't want to ... make it feel like an excuse car," he said. • Without revealing specifics, Oppenheiser said every Camaro variant will be faster than the model it replaces. •The interior is vastly improved. We got an up-close look in the cabin of one of the cars revealed with a red and white layout, and the materials are much better.
