GM 8-speed transmission lawsuit granted class action certification

A story on Autoblog about potentially faulty 8-speed automatic transmissions from General Motors in 2019 has, as of the day this was published, 166 comments, mostly from owners of cars and trucks who say they are experiencing "a hesitation, followed by a significant shake, shudder, jerk, clunk, or 'hard shift' when the vehicle's automatic transmission changes gears." At the time, lawyers were seeking statewide classes in at least six states. As of today, the Detroit Free Press reports that a judge has granted class action status to a lawsuit brought by 39 plaintiffs across 26 states covering the transmission issue. The lawsuit specifically applies to vehicles that are equipped with GM's 8L90 or 8L45 8-speed automatic transmissions made between 2015 and March 1, 2019. Both of these transmissions are similar units, the 8L45 being slightly lighter version used in fewer vehicles than the beefier 8L90, and are designed for front-engine, rear- or all-wheel drive applications. The lawsuit alleges that the erratic transmission behavior makes some vehicles unsafe to drive. Ted Leopold, partner at Cohen Milstein and the court-appointed lead counsel for the case, said in a statement, "General Motors knowingly sold over 800,000 eight-speed transmission vehicles, which they knew to be defective for years, and yet made the business decision not to tell its customers before purchase." He added, "Dealers were directed to tell the customers that harsh shifts were ‘normal' or ‘characteristic.Â’ Such decision making is both highly irresponsible and emblematic of what GM believes it can get away with." The vehicles included in the court order with potentially faulty transmissions includes: 2015-2019 Chevrolet Silverado 2017-2019 Chevrolet Colorado 2015-2019 Chevrolet Corvette 2016-2019 Chevrolet Camaro 2015-2019 Cadillac Escalade and Escalade ESV 2016-2019 Cadillac ATS, ATS-V, CTS, CT6, and CTS-V 2015-2019 GMC Sierra, Yukon, Yukon XL, and Yukon Denali XL 2017-2019 GMC Canyon Some additional details of the lawsuit can be found at the Cohen Milstein site, including claims that "since 2015, GM has issued thirteen versions of a “technical service bulletin,” or “TSB,” related to this shifting issue alone." The statement from Cohen Milstein says that a "second action regarding GM vehicles with 8L transmissions is also underway in Battle v. General Motors, LLC, 2:22-cv-108783.

Chevy Volt outsells Nissan Leaf for first time since October 2013

It's been a rough summer so far for both the Chevy Volt and the Nissan Leaf, the first two plug-in vehicles from major automakers that ushered in the modern plug-in era. In June 2015, sales were down from their 2014 levels. The Leaf was down 11.6 percent and the Volt was down 31.1 percent. For July 2015, things didn't get much better. July 2015's Volt sales of 1,313 were down 35 percent from July 2014 and are down 34.8 percent for the year-to-date. Nissan, on the other hand moved only 1,174 Leafs last month, down 61.1 percent. So far this year, Leaf sales are down 30.2 percent. What's interesting with this steep decline in Leaf sales is that allowed the Volt to outsell the Leaf for the first time since October 2013. Back then, the Volt sold 2,022 compared to the Leaf's 2,002 units. So far, Nissan has sold 83,312 Leafs in the US since the EV went on sale in late 2010. Chevy has sold 80,292 Volts. Even though Tesla doesn't release monthly sales figures, there's a good chance that the pricey Model S was once again the best-selling EV in the US in July, as it was in the first three months of 2015. At that time, Tesla delivered an average of just under 2,000 Model S EVs a month. We might get some insight into more recent numbers during the quarterly investor call on Wednesday. As we've said before, the low sales for the aging plug-ins can be explained by the fact that both the Leaf and the Volt are due for upgrades. The second-gen Volt is coming in a few months. Nissan is being cagey about when the updated Leaf will arrive, but given these latest sales figures, we wouldn't be surprised if the undisclosed timetable gets move up somehow. 2016 Chevrolet Spark lights up New York

The little Spark has been somewhat of a surprising entry in the modern Chevy lineup in the US. Given its diminutive stature, you might have expected the slightly larger Sonic to cannibalize the tiny sibling's sales, but that hasn't happened. The Bowtie moved 39,159 Sparks in the US in 2014, a 14.7 percent boost from the previous year. Now at the 2015 New York Auto Show, the latest generation is being unveiled with a new engine and much improved styling. Replacing the current 1.2-liter four-cylinder is an all-aluminum 1.4-liter unit making 98 horsepower. That still doesn't sound like much, but it's 16 percent more than the 2015 Spark. The new mill can be connected to either a five-speed manual or a continuously variable transmission with which Chevy estimates 40 miles per gallon highway fuel economy. The 2016 Spark also gets a longer wheelbase and 1.6-inch lower overall height. Combined with more elliptical headlights at the front, the changes make for a somewhat more sleek appearance than the current, boxy model. The platform underneath is more rigid as well, and Chevy claims the latest underpinnings mean better handling and lower NHV levels inside. The little hatch isn't growing up too much, though, and gets a trio of new colors that sound like jellybean flavors: Toasted Marshmallow, Kalamata and Splash. Chevy is packing the interior with better quality materials and improved tech. Chevy's latest seven-inch MyLink system sits in the center stack with a capacitive touchscreen, and it now comes with a physical volume control and other buttons for easier use. All models also get a rearview camera, and a LCD instrument cluster remains in front of the driver. The available suite of safety systems includes Forward Collision Alert, Lane Departure Warning and Side Blind Spot Alert. The 2016 Spark goes on sale in the US in the fourth quarter of 2015 and is produced in South Korea. Expect a gallery showing off all its new styling from the New York show floor soon.
