GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

GM admits goal of 500,000 EVs by 2017 won't be met

After a little over four years of Chevy Volt sales, General Motors has a better handle on how many people it expects will buy cars with plugs. And it's less than the company thought back in 2012, when then-senior vice president of global product development, Mary Barra, said that GM expected to sell 500,000 "vehicles with electrification" by 2017. In a sustainability report released this week, GM says that half-million vehicle target will not be met but that it still, "believes the future is electric." In the report, GM says that, "For our commitment to electrification, our forecasted outlook currently projects us, along with the broader automotive industry, falling short of expectations for 2017. ... We continue to aspire to our stated goal." GM's electric lineup includes the Volt, the recently popular Spark EV, the slow-selling Cadillac ELR and upcoming Malibu Hybrid, CT6 plug-in hybrid and eAssist technology in the Buick LaCrosse and Regal. GM says it has 180,834 electrified vehicles on the road in the US today. In 2013, it had 153,034; 95,578 in 2012, and 39,843 in 2011. The company's next big plug-in vehicle will be the second-gen Chevy Volt, which is coming to market later this year, followed by the 200-mile Bolt EV coming, we think, in 2017. NHTSA probes 2010 Chevy Tahoe for side airbag issue

After a person was killed in a rollover accident in a 2010 Chevrolet Tahoe in Texas in 2011, the National Highway Traffic Safety Administration is considering whether to conduct a deeper investigation into a potential problem with the model's side airbags. According to the petition filed with the government agency, the SUV's rollover side curtain airbag deployed in the accident, but the design allegedly still allowed some of the occupants in the second- and third-row seats to be ejected from the vehicle. One of them died in the crash. Based on NHTSA's preliminary review, this is the only report of this type of incident happening in a 2007-2015 Tahoe or GMC Yukon. "GM investigated the complaint that is the basis of the petition and found no defect trend," company spokesperson Alan Adler said to The Detroit News, and said the automaker will cooperate with the feds. Still, "a defect petition has been opened to evaluate the issue and make a grant or deny decision," according to NHTSA. Depending on the agency's findings, this could lead to a full investigation and possible recall affecting an estimated 58,000 vehicles. The petition cites a 2011 Texas crash involving a model year 2010 Chevrolet Tahoe, which allegedly resulted in multiple occupants to be ejected. One of the ejected occupants was fatally injured. ODI's preliminary review of its consumer complaint data found no similar reports of occupant ejections on 2007-2015 Chevrolet Tahoe and GMC Yukon vehicles.
