GM isn't liable for punitive damages in ignition switch cases
Wed, Nov 20 2019NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 'Killing a Duramax' Gale Banks YouTube series methodically tunes a diesel to death
Thu, Feb 27 2020Learning or perfecting a skill by watching YouTube videos is known as attending YouTube University. GM Authority picked up on one of the video site's more fascinating courses, hosted by Gale Banks; in a fair world, he should be referred to as Professor Banks when it comes to diesel engines and truck tuning. A few months after GM introduced the updated L5P 6.6-liter Duramax diesel V8 in the 2020 Chevrolet Silverado HD and GMC Sierra HD that ships with 454 horsepower and 910 pound-feet of torque, Banks decided he wanted to methodically tune the engine to death. The purpose of the resulting series, called "Killing a Duramax," is to push more power out of the engine in order to discover which parts break and when — or, as Banks puts it, force-feed the Duramax "until the crank hits the street and the heads hit the hood." With that knowledge, Banks can figure out all the weak points on his way to building what he calls a "Superturbo," that being a supercharged, twin-turbo race engine with more than 1,000 hp. What makes the series fascinating is Banks' knowledge, paired with the company's comprehensive iDash engine monitoring system that keeps tabs on a glut of parameters every step of the way. So for instance, you get Banks explaining the differences between inches of mercury and barometric pressure, how those are different from the water content of the air measured in grains, then showing those readouts on the iDash, then explaining in detail how they affect the air density in the Duramax system. The stock Borg-Warner variable turbo gets a lot of airtime — Banks accuses it of being "out to lunch" because he feels it's the weakest link on the engine. That turns into a turbo teardown and a deep explanation of performance pitfalls, such as when air pressure on the turbine begins to diverge from the boost pressure coming from the compressor. Banks says he can keep close tabs on where power's coming from, because the iDash monitors the horsepower contribution provided by the ambient air, the turbo, and the intercooler separately. The major changes so far are a stouter Precision 7675 turbo and TurboSmart wastegate (episode 5), a twin intake (episode 6), a custom liquid-cooled intercooler from a marine engine, a new GM oil cooler and synthetic oil (episode 10), and new injectors (episode 11).
GM and Isuzu to partner for medium-duty commercial truck
Tue, Jun 16 2015General Motors is returning to the medium-duty truck business in the US for the first time since 2009 thanks to a new deal with longtime-partner Isuzu. The arrangement brings the Isuzu N-series models to Chevrolet dealers with the Bowtie's branding on them in 2016. There are six medium-duty Chevy models arriving at dealers in regular cab and crew cab bodies: the 3500, 3500HD, 4500, 4500HD, 5500, and 5500HD. The trucks will be sold as a bare chassis for buyers to outfit to their needs. Depending on model, customers will have the choice of an Isuzu-sourced 3.0-liter and 5.2-liter diesel engines or a 6.0-liter V8 gasoline-fueled engine from GM and six-speed gearbox. According to company spokesperson Bob Wheeler to Autoblog, the diesel models will be built in Japan and the rest assembled from knockdown kits in Charlotte, MI. This kind of vehicle sharing isn't uncommon for GM in the commercial segment, and it already partners with Nissan to use the Japanese brand's NV200 as the City Express van. The General also once owned a significant stake in Isuzu, and the two have remained collaborators even since then. To strengthen the product lineup, GM and Isuzu will explore the use of GM commercial vehicle components for Isuzu low cab forward trucks and GM will continue to produce and supply the 6.0L V-8 gas engine and six-speed transmission for Isuzu gasoline-powered low cab forward trucks. Isuzu and GM have maintained a strategic partnership for more than 40 years, producing collaborative business opportunities throughout the world. This agreement continues that tradition and reinforces a long-term relationship that helps to explore future collaborations in the U.S. commercial vehicle business.
