GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM takes 2020 full-size pickup sales crown

It's no secret that 2020 was an unconventional year for auto sales. Extenuating circumstances or not, it was a year of upheaval even for ever-resilient (and ever-profitable) pickups, with General Motors taking the crown from Ford in the full-size segment.  The Ford F-Series still outsold every other full-size pickup nameplate in the country by a significant margin. It's only when you combine GM's Chevrolet Silverado and GMC Sierra variants that you get a number that exceeds Ford's. This isn't really a new phenomenon, either. In fact, it was only somewhat recently that Ford took the overall full-size crown away from GM, and not only did Ford widen the gap in recent years, but Ram has once again become a legitimate challenger, even managing to outsell the Silverado by a healthy margin in 2019, but never coming close to the F-Series in terms of total volume.  But, 2020 being 2020, things got weird yet again. Ram remains relevant, of course, but Ford got caught with its pants down thanks to the one-two punch of COVID and the generational changeover of the core F-150 model, which resulted in a production interruption as the company's assembly facilities transitioned from building the old 2020 model to the new-for-2021. This perfect storm, as it turns out, was sufficient for GM to walk away with the full-size crown. The Silverado 1500 had a flat year, but the heavy- and medium-duty variants bucked the trend and contributed to a slight uptick in sales for the nameplate, while F-Series tumbled more than 12% (nearly 110,000 units), opening the door for GM to steam ahead.  There were similarly significant shakeups in the midsize truck segment. First, 2020 was the first full year of retail sales for the Gladiator pickup, which surged to fourth place behind the stalwart Tacoma, Ranger and Colorado. GM's combined sales of the Colorado and Canyon are good enough for second place by manufacturer, but nowhere close to what it would take to dethrone Toyota.

Diesel-powered 2020 Chevrolet Silverado, GMC Sierra get big price cuts

General Motors is reducing the price difference between its diesel-powered light-duty pickups and their gasoline-burning counterparts, according to a recent report. As of September 3, 2020, the Chevrolet Silverado 1500 and the GMC Sierra 1500 benefit from a $1,500 price cut when they're ordered with a turbodiesel under the hood. Enthusiast website GM Authority first reported the news after looking at internal documents sent to dealers across the nation. It wrote the discount applies to in-stock and in-transit units of the Silverado and the Sierra (pictured), and it added dealers will begin receiving amended window stickers on September 8. And, it's not just a quick, easy way for General Motors stores to clear out 2020 inventory. Incoming 2021 models will benefit from it, too. Chevrolet's cheapest diesel-slurping 2020 Silverado, a double-cab LT with two-wheel drive, now starts at $44,000 once a mandatory $1,595 destination charge enters the equation. For context, the same configuration costs $38,795 including destination when it's ordered with the 2.7-liter turbocharged four-cylinder, which is the smallest and cheapest engine on the roster. Selecting the more efficient engine option costs buyers $5,205. At the other end of the spectrum, the crew-cab High Country with a standard cargo box and four-wheel drive is now priced at $59,690. Walk a block to the GMC store, and you'll need to spend between $44,470 (double-cab SLE with two-wheel drive) and $61,685 (crew-cab Denali with a regular cargo box and four-wheel drive) for a diesel-powered Sierra. It doesn't sound like either company is making major mechanical changes to the trucks for 2021. Both are powered by a 3.0-liter straight-six Duramax engine, which makes 277 horsepower and 460 pound-feet of torque. Rear-wheel drive and a 10-speed automatic transmission come standard, and four-wheel drive is offered at an extra cost. In its most efficient configuration, the Silverado returns 23 mpg in the city, 33 mpg on the highway, and 27 mpg in a mixed cycle, impressive numbers for a body-on-frmae pickup that's as heavy as it is capable. Ram's diesel-powered 1500 posts EPA estimates of 22, 32, and 26, respectively. Ford pledged the recently-unveiled 14th-generation F-150 will offer a turbodiesel engine, too, but its fuel economy figures are not available yet.
