GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

Chevy Volt outsells Nissan Leaf for first time since October 2013

It's been a rough summer so far for both the Chevy Volt and the Nissan Leaf, the first two plug-in vehicles from major automakers that ushered in the modern plug-in era. In June 2015, sales were down from their 2014 levels. The Leaf was down 11.6 percent and the Volt was down 31.1 percent. For July 2015, things didn't get much better. July 2015's Volt sales of 1,313 were down 35 percent from July 2014 and are down 34.8 percent for the year-to-date. Nissan, on the other hand moved only 1,174 Leafs last month, down 61.1 percent. So far this year, Leaf sales are down 30.2 percent. What's interesting with this steep decline in Leaf sales is that allowed the Volt to outsell the Leaf for the first time since October 2013. Back then, the Volt sold 2,022 compared to the Leaf's 2,002 units. So far, Nissan has sold 83,312 Leafs in the US since the EV went on sale in late 2010. Chevy has sold 80,292 Volts. Even though Tesla doesn't release monthly sales figures, there's a good chance that the pricey Model S was once again the best-selling EV in the US in July, as it was in the first three months of 2015. At that time, Tesla delivered an average of just under 2,000 Model S EVs a month. We might get some insight into more recent numbers during the quarterly investor call on Wednesday. As we've said before, the low sales for the aging plug-ins can be explained by the fact that both the Leaf and the Volt are due for upgrades. The second-gen Volt is coming in a few months. Nissan is being cagey about when the updated Leaf will arrive, but given these latest sales figures, we wouldn't be surprised if the undisclosed timetable gets move up somehow. Sinkhole Opens Up In National Corvette Museum, Swallows Eight Cars

More cars are being moved inside the National Corvette Museum in Bowling Green, Ky. to avoid falling down the same sinkhole that swallowed eight classic sports cars early this morning, Autoblog reported. Museum officials said the hole was discovered when motion sensors activated around 5:45 a.m. The rescue mission can be viewed on the museum's live feed cameras, which weren't working after the sinkhole emerged. A 1993 ZR-1 Spyder and a 2009 ZR1 "Blue Devil," both on loan from General Motors, were among the cars that fell into the sinkhole. The museum owned the other affected Corvettes, which included a 1963 Corvette, a 1984 PPG Pace Car and the 1 millionth Corvette ever produced. The state of the cars at the bottom of the hole isn't known, but trial lawyer and sinkhole expert Ted Corless said the cars may be a total loss for the museum and GM. "Most states, including Kentucky, exclude damage caused by sinkhole activity," he said. "There will be, in all likelihood, a claim made, but a lot of policies would specifically exclude these kinds of damages." Corless has 15 years experience dealing with sinkholes. He said that typically neither the building, nor the cars themselves are protected under their insurance policies. "I would have to say, more likely then not, they're going to have an uninsured loss measured in the hundreds of thousands of dollars." The museum is closed Wednesday while a structural engineer assesses the damage.
