GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. The students spent three years transforming an ordinary Chevy Malibu into a revolutionary vehicle. Not far from the building where General Motors once invented the Chevy Volt, a dozen or so college students are standing on the blacktop alongside a test track, watching a professional driver push the limits of a plug-in hybrid car they've built that's far more radical. These students, from Colorado State University, have spent the past three years transforming an ordinary Chevy Malibu into a revolutionary vehicle. At first glance, it still looks like a regular sedan. But under the hood, they've installed a hybrid powertrain that contains both hydrogen and electric power sources. Even by the standards of the Department of Energy competition they're participating in, it's an outlier. That's exactly what they had in mind. "We didn't want to come here and tell them how to build a better Volt," said Tom Bradley, faculty adviser for the Colorado State team. "They already know how to do that. We can tell them how to think about these possibilities in a whole new way." After three years of work, it all comes down to this. The Colorado State team was one of 15 that came to GM's Milford Proving Grounds last week for the final stretch of the EcoCar2 competition, which challenges regular college students who have no automotive experience to do nothing less than reinvent the American car. The teams have come from across North America, and include schools like Ohio State and Virginia Tech that have a long history of participating in similar competitions, and schools like the University of Washington and Embry-Riddle Aeronautical University that are here for the first time. After three years of work, it all comes down to this. The teams have operated 24 hours a day for almost two weeks here at the Proving Grounds, running a gamut of tests that include a 310-point safety inspection, emissions and energy-consumption tests and road tests, in which professional GM drivers ensure they're road worthy. The winning team will be announced tonight in Washington D.C. Revolutionary cars, ordinary package While other green-car competitions encourage extreme designs, this one comes with a somewhat constraining twist: Yes, students must improve fuel economy and reduce emissions, but in the end, they still have to have a car that would appeal to mainstream customers. In practical terms, that means they must keep conveniences like air conditioning and trunk space.

Fernando Alonso just misses qualifying for Indy 500 on first day

Former Formula One world champion Fernando Alonso will need a clutch run on Sunday to qualify for the Indianapolis 500 on May 26 after he failed to seal a guaranteed spot on Saturday. The Spaniard tried fives times to put his McLaren Racing Chevrolet in the top 30, but wound up one spot short. He can make the 33-car field only through a six-car shootout on Sunday that will determine the race's final three drivers. "We have another chance to be in the race," Alonso, who is seeking to make his second Indy 500 field, told IndyCar TV. The Spaniard twice got inside the top 30 but both times was bumped outside the mark, with JR Hildebrand and Graham Rahal the final two drivers to seal qualifying spots. Britain's Pippa Mann will be the only woman in the race, qualifying 30th in 227.244 mph. Race positions 10-30 were determined during the day-long qualifying with Saturday's nine fastest drivers set to return on Sunday to decide pole. Spencer Pigot, driving the Ed Carpenter Racing Chevrolet, led qualifying with a four-lap average of 230.083 mph. He was followed by 2018 winner Will Power of Australia (230.081) and Simon Pagenaud of France (229.854). The troubles for Alonso, whose top four-lap average was 227.224 mph, were exacerbated by a punctured tire in his first qualifying run. "That didn't help," Alonso told reporters. "But, obviously, our performance has been quite bad all week. Quite poor." The Spaniard crashed his Chevrolet in practice on Wednesday and missed nearly two full days of practice while a backup car was prepared. He returned on Friday. Alonso said he was worried the McLaren team was "not ready for the challenge." "We've been slow. You see Juncos Racing crashing yesterday and being ready at 6 o'clock. That's impressive," he said. "For us, we've been a little bit slow on everything." Alonso is bidding to join Graham Hill as the only drivers to achieve the 'Triple Crown of Motorsport' with an Indy 500 victory. He previously won the Monaco Grand Prix and Le Mans 24 Hours race. He also won two Formula One drivers' titles.
