GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. I remember reading a story around the time Fast and Furious: Tokyo Drift came out. It focused on one of the star cars of that film, a 1967 Ford Mustang fastback that started the film as a shell, and in a pinch, was transformed into a modified masterpiece, complete with the RB26DETT engine from a Nissan Skyline GT-R (which started the film under the hood of an S15 Silvia). There was a genuine (and in our minds, absurd) fear in the article that taking a piece of classic American iron and fitting a twin-turbocharged JDM engine would result in some awful trend in the classic car community. If you thought a GT-R-powered classic Mustang was sacrilege, though, this car will probably make you vomit. For the rest of us, it's a neat piece of engineering. Shown above is a 1963 Ferrari 250 GTE, and yes, that's a 302-cubic-inch, small-block Chevrolet V8 under the hood. On top of that, it uses the six-speed manual transmission from a Viper, a nine-inch Ford rear end, and Mitsubishi-sourced paint. So yeah, it's a FrankenFerrari. Junkyard Gem: 1988 Chevrolet Spectrum Sport Coupe

Before General Motors created the Geo brand for cars built or designed by its overseas partners, the Chevrolet Division put its badges on U.S.-market versions of the Toyota Corolla Sprinter, the Suzuki Cultus and the Isuzu Gemini. Those cars were known as the Nova, the Sprint and the Spectrum, and all became Geos starting with the 1989 model year. Today's Junkyard Gem is one of the last Chevy Spectrums ever sold, found in a Denver self-service yard a few months ago. Midway through 1988, the Chevrolet Spectrum abruptly became the Geo Spectrum and was assigned to the 1989 model year. This car was built in May 1988, making it one of the very last of the pre-Geo Spectrums. The Chevrolet/Geo Spectrum was available as a four-door sedan and as a three-door hatchback, from the 1985 through 1989 model years. For 1988 only, a Spectrum Sport Coupe package, featuring some trim upgrades and these rad decals, could be had on the hatchback. This car was essentially identical to its Isuzu-badged counterpart, the I-Mark. In 1988, the MSRP for the cheapest possible Chevy Spectrum hatchback (the stripped-down Spectrum Express) was $6,495, while its somewhat better-equipped I-Mark twin started at $7,439 (that's $17,128 and $19,617 in 2023 dollars). Meanwhile, the base Hyundai Excel hatchback listed at $5,295 and the Yugo GV cost a hilarious $4,199 ($13,963 and $10,941 in today's money). Power came from this 1.5-liter SOHC four-cylinder, rated at 70 horsepower. A turbocharged version with 110 horsepower was available as well. You could get an automatic transmission in the Spectrum, but this car has the base five-speed manual. This car didn't get the optional air conditioning, but at least it has the traditional Isuzu HVAC control icons featuring blow-dried hair and high-heeled dominatrix boots. Just over 170,000 miles on the odometer. Someone installed a pretty good (for the 1980s) Blaupunkt Charlotte CR148 cassette deck in the dash. This was a necessity if you wanted to enjoy full appreciation of the music of the era. The Spectrum is special! It's as slick as city rain. "I didn't spend a lot of money but with my Spectrum it looks like I did." Joe Isuzu mocked Toyota salesmen when pitching the I-Mark. As was nearly always the case during the 1980s, the JDM ads for the same car were much more fun. They should have recreated this commercial with Spectrums.
