GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Cadillac XT4 crossover to be built in Kansas City

Cadillac's upcoming XT4, a crossover we've previously known as the XT3 in a long series of spy shots of heavily camouflaged mules, will be built at General Motors' assembly plant in Kansas City on the same platform as the Chevrolet Malibu, Bloomberg reports, citing people familiar with the plan. That will give Cadillac another entry in the red-hot luxury crossover segment and, GM hopes, help to reverse a sales slump in the U.S. It'll also breath life into the Kansas City plant that makes the slow-selling Malibu, where GM cut a third shift last year, by sharing the assembly line between the crossover and sedan and defraying costs for each vehicle. The XT4 was known most recently as the XT3, with styling cues based on the Escala concept sedan from 2016. It's slightly smaller than the XT5, Cadillac's top-selling vehicle, and will also augment the full-size Escalade in Cadillac's stable of SUVs when it makes its expected debut later this year. Cadillac last week reported its second-highest-ever sales mark with 356,467 vehicles, an increase of 15.5 percent over 2016. But that mark papers over an 8 percent sales decline in the U.S. to 156,440 vehicles. Chevy Bolt will go into production in Michigan in 2016 [UPDATE]

While nothing official has been announced, it appears that General Motors may actually put the all-electric Chevy Bolt into production next year. That's the rumor that Reuters is reporting, citing two sources at suppliers for the upcoming $30,000 EV (although that $30,000 number bears some scrutiny). This rumor does fit in with earlier comments that the Bolt would arrive on the market in 2017. If it gets built, the Bolt will share more than a similar-sounding name with the Chevy Volt: the EV will be put together in metro Detroit. Reuters says the 200-mile electric car (and an Opel version) will be made in "an underused small-car plant north of Detroit," which means the Orion Township plant. GM could make between 25,000 and 30,000 Bolts a year there, if what the suppliers are saying is true. We have asked GM for a statement on this story and will update it if we hear back. UPDATE: General Motors manager of electrification technology communications, Kevin Kelly, told AutoblogGreen that, "Bolt EV Concept is just that – a concept. We're currently evaluating the vehicle program, but do not have any production announcements to make at this time."
