GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Autonomous tech will drive motorheads off the road

While autonomous technology could make car travel much safer and more efficient — and automakers and marketers are salivating over the prospect of a "passenger economy" that could potentially generate $7 trillion by 2050 — those of us who enjoy driving are not so stoked. Experts have predicted that as autonomous vehicles are deployed in large numbers, human-driven cars eventually could be outlawed on public roads due to the carnage they create, which is currently more than 41,000 deaths a year in the U.S. alone and climbing. Such scenarios have driving enthusiasts envisioning a "Red Barchetta" style nightmare becoming reality, making Rush lyricist Neil Peart a clairvoyant as well as one of rock's most badass skin-pounders. But there could be a couple of refuges left for motorheads, and they won't be on public roads. As Popular Science's Joe Brown points out in a recent editorial, we're seeing a wave of vehicles being offered by legit mainstream automakers that aren't made for public roads. The poster child of this vanguard is the 2018 Dodge Challenger SRT Demon, which comes with a crate full of goodies that lets you turn the already formidable street-legal muscle car into a drag-strip dominator. Brown also notes that two out of five of the Ford GT's driving modes are for use on the track, "catering to the $450,000 machine's club-racing clientele." We're also currently enjoying the heyday of production off-road-ready pickups that kicked off with the Ford Raptor in 2009. The latest salvo in this escalating war of overachieving trucks is the Chevy Colorado ZR2 that can take on the likes of California's Rubicon Trail without issue. Brown also gives a shout-out to his magazine's Grand Award Winner, the Alta Motors Redshift MX, which "isn't even allowed on public roads" and is "meant for bombing around motocross tracks, big backyards and single-track woods trails." If you follow Brown on Instagram, you know that he's also a two-wheel aficionado, and he points out that sales of off-road bikes are leaving street machines in the dust. Sales of off-highway motorcycles rose 29 percent between 2012 and 2016, according to the ­Motorcycle Industry Council — compared to 6 percent for road-bike sales during the same period. "That's a nearly 400-percent drubbing," Brown remarks.

No diesels in the running for 2016 Green Car Of The Year

It's a new era for the Green Car Of The Year. In the past, the theme of the award was to take a broad look at alternative powertrains and pick the best among them. "Clean diesels" from the Volkswagen group were often among the finalists and won the award twice. For the 2016 edition - which will be handed out at the LA Auto Show next month - not a single diesel made the list. There's little wonder why. Green Car Journal, which names the winner with a panel of experts, had to strip two VW brand vehicles of their past wins. The 2009 VW Jetta TDI, which won in 2008, and the 2010 Audi A3 TDI, which won in 2010, have both lost their titles now that the world knows about the "defeat devices" that VW installed in many of its TDI vehicles around the world. So, what does that leave us with for 2016? Two plug ins, a hybrid, and two gas vehicles. The two electric vehicle are the Audi A3 e-tron and the Chevy Volt, while the all-new Toyota Prius (which will come with a plug-in version later) is the lone pure hybrid. Rounding out the pack are two efficient gas models: the Hyundai Sonata and the Honda Civic. This is the tenth year for the Green Car Of The Year, and it will be interesting to see if diesels can come back into the award's good graces (for the record, no diesels were among the finalists in 2013, either) in the future.
