GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevrolet will preview electrified Silverado-like truck at CES 2021

After abandoning its fight against California's lawmakers, General Motors is shifting its electrification offensive into high gear. CEO Mary Barra will give the opening keynote address at the 2021 Consumer Electronics Show (CES), which will be held online, and Chevrolet will provide a peek at its electrified pickup during the event. Insiders familiar with the carmaker's plans told Bloomberg that Barra's address will highlight ways that electrification can improve the environment and society in general. General Motors president Mark Reuss will speak, too, and his remarks will be followed by a video that will highlight several future products, including what the sources referred to as "a plug-in Chevrolet pickup, some Cadillac models, and vehicles for other brands." These comments ask more questions than they answer, because plug-in means many things in this context. Chevrolet's electric Bolt is a plug-in vehicle, as is the upcoming GMC Hummer, but the plug-in hybrid Jeep Wrangler 4xe is one, too, and it's clearly not all-electric. It's often been assumed that Chevrolet's upcoming electrified truck will be electric, but it might arrive with a hybrid powertrain or a gasoline-powered range extender. Chevrolet could also follow Ford's lead and plant a stake in both the hybrid and the electric pickup segments. It's too early to tell if Chevrolet will unveil the same truck it previewed during a presentation earlier in 2020. Shown briefly, it wore a highly futuristic design that gave it a sleeker look than the current-generation Silverado. Cadillac's presentation promises to be interesting, because the company hinted it might abandon gasoline entirely by 2025, several years earlier than expected, even though its dealers aren't all on board with the shift. Going electric-only in about four years would force the brand to conduct a massive overhaul of its range. As of writing, there is not a single electric Cadillac in showrooms, but the Lyriq will arrive in late 2022 as a 2023 model. It's difficult to tell what's in store for other brands, but there are several cars that General Motors could show during CES. Buick doesn't sell an electric car in the United States yet, for example. Alternatively, GMC is working on an SUV variant of the Hummer, and it has started developing an electric truck. Going back to Chevrolet, our crystal ball tells us we'll see more of the 2022 Bolt EUV during the next edition of the tech show, too.

Recharge Wrap-up: Ford steals Best Green Brand spot from Toyota, EV buyer survey goes online

Chevrolet is one of the Top Global Green Brands of 2014, according to brand consultancy firm Interbrand. Chevy ranks number 32 on the list, which cover brands across a wide variety of segments. The report measures brand perception and brand performance, and the gap between the two is small for Chevrolet. "The company is not only actively demonstrating its environmental commitment," says Interbrand CEO Jez Frampton. "It's communicating those efforts in an authentic way that resonates with customers." Chevrolet cites its Spark EV, Volt and Cruze models as reason for its green cred. This is the first time Toyota didn't take the top spot. Being 32nd is good and all, but other automotive brands ranked much higher than the Bowtie. Ford, Toyota, Honda and Nissan took the top four spots in the report, respectively, with BMW, Volkswagen and Mercedes-Benz all besting Chevrolet. The big takeaway here is that Ford topped the list. In the Top Global Green Brand list's four-year history, this is the first time Toyota didn't take the top spot. Ford was second on the list last year, and 15th in 2012. "Ford embodies everything the business of the future must be: efficient, visionary, flexible, adept at problem-solving, cooperative, and focused on creating shared value," Interbrand says on its website. "From unveiling a first-of-its-kind solar-powered vehicle, the C-MAX Solar Energi Concept, to partnering with peers across sectors to do the seemingly impossible - like creating bio-plastic out of tomato fiber with Heinz-Ford is showing us what's possible." It bears mentioning that Ford's most recent MPG adjustments came after the study was conducted. Ford is also making the news for its 1.0-liter EcoBoost engine earning International Engine of the Year for the third straight year. Awarded Best Engine Under 1.0 Liter, the turbocharged three-cylinder motor earned high praise from judges. "This year's competition was the fiercest yet, but the 1.0-liter EcoBoost continues to stand out for all the right reasons – great refinement, surprising flexibility and excellent efficiency," said International Engine of the Year co-chairman Dean Slavnich. "The 1.0-liter EcoBoost engine is one of the finest examples of powertrain engineering." The 123-horsepower engine powers the Fiesta 1.0-liter EcoBoost, and will be available in a version of the Ford Focus in the US later this year. See more about the award in the press release, below.
