GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Now that 2014 is no more than a set of numbers on spreadsheets, at last, the grist mill gets its first real load to chew on. The number one selling vehicle in America last year was the Ford F-Series, a fact that should surprise you only if your family name is Van Winkle and your naps tend to last 38 years, which is how long the Ford pickup has ruled our buying landscape. Even though series sales were down 1.3 percent, it still racked up 753,851 units. That's 2,065.3 sales per day, every day, all year. The Chevrolet Silverado, up 10.3 percent for the year, was still a daylight second at 529,755 units. The cab-and-bed love continued into third place with the Ram 1500-3500 trucks, gaining 23.6-percent year-on-year to clock 439,789 units. The robust turnout at The Bighorn and Jeep helped Fiat-Chrysler increase its sales by 16 percent, past the two-million mark. Our number one car? The Toyota Camry, staying in first place with a 4.9-percent sales boost to 428,606 sales, trailed again by the Honda Accord at number five with 388,374 sales. Accord sales rose six percent, and if it's any consolation to Honda for coming in second - not that it needs one - it is the only manufacturer to have three vehicles in the top ten. The rest of the list: the Nissan Altima with 335,644 sales (+4.7%), the Honda CR-V with 355,019 (+10.2%), the Toyota Corolla/Matrix combo with 339,498 (+5.9%), the Honda Civic with 325,981 (-3.1%), and the Ford Fusion with 306,860 sales (+2.9%). Total sales for the year were up six percent to 16.5 million vehicles, a volume not seen since 2006, aided by a strong December that was up by 11 percent year-on-year. Ford was the top selling brand overall but sales didn't really budge from 2013, while Subaru rocketed up 21 percent to finish with 513,693 sales. At the precious end, BMW, Audi, Porsche and Land Rover all had record years, and Kelley Blue Book thinks we could be looking at 17 million sales for the next two or three years. Jaguar I-Pace vs. Tesla Model 3 and other EVs: How they compare on paper

The 200-mile club of electric vehicles is really growing. The most recent member is the Jaguar I-Pace, the company's first pure EV. It promises luxury, performance, style, and most important, good range. Nearly as recent is the Hyundai Kona EV, and while it doesn't promise luxury or performance like the Jaguar (it's also smaller), it does pack impressive range. With the introduction of both of these electric cars, we thought we would see how they compare against each other, and the other two big names in high-capacity electric cars: the Chevy Bolt EV and the Tesla Model 3. This isn't intended to be a direct, apples-to-apples comparison, as the four are quite different. If anything, they break into two groups: bigger and more luxurious, and smaller and less expensive. Then again, the number of vehicles with this electric range is small and comparisons to EV's with less range wouldn't be too kind to the other guys. Horsepower and torque There is one clear winner here, and that's the Jaguar I-Pace. It packs a whopping 394 horsepower and 512 pound-feet of torque. That comes through a pair of electric motors (one at the front, another at the rear) that provide the Jag with all-wheel drive, the only one of these vehicles to offer it (at the moment). Altogether, it allows the I-Pace to have the best 0-60 mph time of 4.5 seconds. At the other end of the spectrum is the Hyundai Kona EV. It's front-drive, like the Bolt EV, and has effectively the same amount of horsepower as the Chevy at 201 horsepower, but its 0-60-mph time is almost a second slower. And the low-range version of the Kona, excluded because it doesn't go more than 200 miles between charges, is slower still. The Tesla Model 3 is the only vehicle with rear-wheel drive, and with a 0-60 mph of 5.1 seconds for the Long Range model, it is still very quick. Range and energy use Frequently, the all-consuming question with electric cars is, "How far can I go on a charge?" And to go the farthest, you need the long-range Tesla Model 3. It can go 310 miles. It has the added advantage of being able to use the network of Tesla Supercharger stations, though they are pay-per-use with the Model 3. Even the lower capacity Model 3, with just 220 miles of range, can use these stations.
