GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2015 Chevrolet Silverado 1500 Custom Sport Quick Spin

Coincidentally, the week we had the 2015 Chevrolet Silverado 1500 Custom Sport a friend asked, "What would you buy if you could only have one vehicle for everything?" After a week's driving and trailer hauling, very close to first choice would be an American pickup. They're all so good now, you can't lose. And as we found in the Chevy you can go anywhere and haul anything, and you pay no penalty for capability until you try to find an open space on the street to park. Nicely equipped versions like the Custom Sport aren't cheap, but if you need a truck and you like the look of this one, it is really good. Driving Notes The cabin is big and inviting, and everything in it is big and inviting. The materials are nice enough to look and feel swanky but not so lavish that you're afraid to get them dirty. The seats are sized for adult male bears but they don't swallow you up. The sunroof is big enough to be an observatory. It's also quiet. The only time it gets mildly unruly is when you call for power and the engine has to downshift a few gears, otherwise you don't hear the exhaust unless you roll down the window. It looks like it was designed with a T-square. I quite like it, the body-colored bumpers toning things down, the 20-inch wheels doing a much better job of filling those ample arches than the standard 17-inchers. The truck is built for people who take their work and all their gadgets with them. The front console has three USB ports, two 12-volt cigarette lighter ports, and a three-prong 110-volt outlet. The giant cubby at the base of the console has an insert to hold a clipboard or a small tablet. The abyss under the center armrest has one more 12V cigarette lighter, two more USB ports, an SD card reader, and another specialized holder for something the size of a small tablet. There's a WiFi hotspot so the streaming never has to stop. The Chevrolet navigation was trouble-free as usual, and you can input destinations on a QWERTY touchscreen keyboard. Every nav system should be so solid. The Silverado has some of the best feature implementations we've encountered in any vehicle. The lane departure warning and park assist systems don't vibrate the steering wheel, they vibrate the seat. The left, right, and middle of the seat bottom will pulse as necessary, an intuitive, peripheral way to deliver a message that doesn't interrupt your primary focus. The rear-view camera is no longer offset, it's centered.

Chevy Silverado gets star-studded treatment at SEMA

Chevrolet has quite a presence ready for the 2015 SEMA Show, including custom takes on the Camaro and Spark. As one of the company's most popular models, the Silverado isn't left out of the fun, either, thanks to a trio of concepts to highlight what's possible for the aftermarket event. Camouflage is supposed to blend in, but the naval-inspired, Razzle Dazzle design on the Silverado Special Ops Concept should make the truck pop under the lights at the Las Vegas Convention Center. Based on a Silverado 1500 Z71, the pickup is conceived as a "rescue vehicle special-operations forces." To get behind enemy lines, it packs extra LED lighting, wheel flares for off-road tires, and a GearOn utility rack in the bed. Plus to help get away, Chevy Performance fits an air intake, exhaust kit, and concept six-piston brakes. The Silverado Realtree Bone Collector Concept (above) also wears camo for SEMA, but it's for enjoying the outdoors rather than getting out of battle. Camouflage company Realtree and The Bone Collector host Michael Waddell help with the design for this custom truck that features 22-inch black wheels, a front push bar, LED light bar, and assist steps all from Chevy Accessories. With leather upholstery, Apple CarPlay, and Android Auto inside, the drive to and from the woods should be comfortable, as well. The Silverado 3500HD Kid Rock Concept rounds out this trio and features patriotic styling from the eponymous rock star. "I wanted the design for the truck to be bold, but with features and elements that wouldn't be out of reach for working-class guys," he said about the design, and Kid Rock even visited the factory in Flint, MI, to meet members from UAW Local 598 for some inspiration. The result features a custom chrome grille with a Born Free logo and chrome exhaust stacks. For added excitement, two Gibbs Sports Quadskis are hooked up on the trailer behind it.
