GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy Volt owners log half a billion electric miles, 2015 production starts

As General Motors gets ready to start 2015 Volt production Monday, Chevrolet is looking back at some of the numbers that got the car to where it is today. The headline number is that Volt owners have collectively put more than a half-billion electric miles on their cars. The unsurprising upshot is that, if you went out and bought a Volt, you're pretty keen on getting as many electric miles out of it as possible. 90 percent of all Volt trips are done purely on electric power. The typical Volt driver goes 970 miles between fill-ups, GM says, and that means that 63 percent of all miles are done on battery power. General Motors executive director Larry Nitz gave AutoblogGreen a few more details on the usage habits of Volt drivers, including that 81 percent of commuting miles are electric. Two-thirds of US Volt drivers charge their vehicle 1.4 times a day, a clear indicator of drivers trying to maximize electric miles through opportunity charging. In fact, Nitz said, 90 percent of all Volt trips are done purely on electric power. GM also says that the Volt's official 35 miles of electric range is still doable for many owners who have had their car for more than 30 months. Looking ahead, we know that one upgrade for the 2015 Volt will be 4G LTE connectivity that can turn the car, like others in the GM family, into a mobile wifi hotspot. We're of course much more interested in when GM is finally going to start production of the next-gen Volt, but GM officials would only tell us that they're very excited about the still-secret vehicle, promising we'll be learning more "soon." Nitz did confirm that today's Volt drivers are most interested in three things from the next-gen model: more range, a lower price and a fifth seat. He did not say whether or not GM will be able to deliver on those requests. Jeff Gordon to pace Indy 500 in Corvette Z06

The Chevrolet Corvette has served as pace car for the Indianapolis 500 more than any other vehicle in the century-long history of the race. And this year it'll be at the front of the pack again in the form of the Corvette Z06 driven by Jeff Gordon. With 650 horsepower on tap, the Z06 is among the fastest, most powerful cars ever to serve as pace car for the Greatest Spectacle in Racing – right up there, at any rate, with the ZR1 that led the field in 2012 and the Viper GTS from 1996. For this year's race, it's been decked out in white with special graphics, strobe lights and a red interior. The 99th running of the race will mark the 13th time a Corvette has been tapped for the honor. Gordon, a name better known to NASCAR fans, but certainly no stranger to the track, will handle driving duties. The four-time Sprint Cup champion has won the Brickyard 400 no less than five times, including the very first time it was held back in '94. No driver has won at Indy more than Gordon – a record he shares with Michael Schumacher, who won the US Grand Prix there five times. (AJ Foyt, Al Unser and Rick Mears share the record for Indy 500 victories at four apiece, in case you were wondering.) It'll be a busy Sunday for Gordon, who will also be competing in the Coca-Cola 600 at Charlotte on the same day. Corvette has served as the pace car more than any other vehicle in the race's history. Gordon, who grew up in nearby Pittsboro, Ind., is no stranger to the Indianapolis Motor Speedway. In 1994 he won the inaugural Brickyard 400 – the first-ever NASCAR race at the Brickyard, and has visited the winner's circle there four more times. That makes him one of only two five-time winners at Indy in any series. Michael Schumacher won five Formula One races there.
