Motor Trend reveals 2016 Chevy Camaro as Car of the Year

The 2016 Chevrolet Camaro beat some very steep competition to earn the Golden Calipers as Motor Trend's Car of the Year. The magazine praised the sixth generation's fantastic engines, great handling, and lighter platform. "Our 2016 Car of the Year, the Chevrolet Camaro, is one of the finest driving vehicles in the world at any price," editor-in-chief Edward Loh said, "though its price is well within reach of the average consumer." The Camaro conquered some high-performance challengers to take the victory, including the Audi TT, Mazda MX-5 Miata, and Mercedes AMG GT S. It also bested technologically cutting-edge vehicles like the BMW 7 Series and Toyota Mirai. The latest Honda Civic rounded out the competition. To earn the prestigious award, nine judges evaluated the finalists in six categories: advancement in design, engineering excellence, safety, efficiency, value, and performance of intended function. It praised him for the Japanese brand's massive success in the US like tripling deliveries since 2007. GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case.
