GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. More than half of Mazdas sold in 2018 are CX-5s, and other interesting sales facts

Last year was a seriously good year for carmakers. Overall, more vehicles were sold than in 2017, and the total number wasn't far off of the all-time record in 2016. Digging deeper into the numbers, you'll find some pretty usual stuff including the Ford F-Series still being the bestselling pickup truck in America, and a continued trend toward crossovers. But there are also some oddball factoids tucked in these sales reports, some that defy the trends, and some that are extremes of the public's buying preferences. We've compiled several interesting tidbits from last year's sales right here for your enjoyment. More than half of Mazda's sales were of CX-5s Yes, over half of all Mazda sales were of this one model. The company sold 300,325 cars in America last year, and 150,622 of them were CX-5 crossovers, or 50.1 percent. Just for emphasis, that means the other 49.8 percent of Mazda's sales were split among five other models, the Miata, 3, 6, CX-3 and CX-9. Breaking that down further, the second-best seller was the Mazda3 at 64,638, which isn't even half of the CX-5's sales. People are crazy for Mazda's middle crossover. Volkswagen actually sold more cars than crossovers It's clear that the crossover is the future king of car sales. For most mainstream brands, it already is. Chevy, Ford, Honda, Toyota, Subaru, Mazda and Nissan all sold more crossovers and SUVs than they did conventional sedans and hatchbacks. There are holdouts, though, and one of them is Volkswagen. At the end of 2018, the company sold 189,343 cars and 164,721 crossovers in the U.S. So that's one win for the classic car set, and it's justification for VW to maintain its car line for the foreseeable future. It's a bit of a hollow victory, though. Look closer and you'll see that car sales were down 28 percent from 2017, when VW sold 262,029 cars. Crossovers, on the other hand, jumped 112 percent from 2017 when 77,647 crossovers moved through U.S. dealers. So expect the tables to turn very soon. Mustang is still the muscle-car sales king, but Challenger is the only one to improve Once again, the Ford Mustang topped the muscle-car sales charts, beating out the Dodge Challenger and Chevy Camaro. Ford moved 75,842 of the ponies in 2018, while Dodge sold 66,716 Challengers for second place, and Chevy sold 50,963 Camaros to bring up the rear.

1983 Motorweek showdown pits Porsche 928S vs. Chevy Camaro Z28

Last month, Motor Trend threw the Camaro Z/28 and Porsche 911 GT3 into the bear pit and let them fight it out. Way back in 1983, MotorWeek had the same idea, comparing the Camaro Z/28 to the Porsche 928S. At the time, the Camaro was America's best selling sports coupe, the 928S was Porsche's top-of-the-line model that also had the highest top speed of any car sold here. And the price differential was even more stark then: $13,600 for the Camaro, $45,000 for the Porsche. That put the Z/28's cast-iron, 5.0-liter V8 with 190 horsepower and 240 pound-feet of torque against the all-aluminum 4.7-liter V8 with 234 hp and 263 lb-ft in the 928S. Even with that and the Camaro being 14 inches longer than the Porsche, the American was a surprising 40 pounds lighter than the German. The show took them to Summit Point Raceway in West Virginia to see how close a relative performance bargain could hang with a the German GT. Both had five-speed manual transmissions, but the high-speed corners and tight sections of Summit Point would test other handling variables, including the "bone-rattling" Camaro's solid rear axle and disc and drum brake setup vis-a-vis the four-wheel disc brakes and independent suspension on the "firm-but-smooth" Porsche.
