GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2016 Chevrolet Spark lights up New York

The little Spark has been somewhat of a surprising entry in the modern Chevy lineup in the US. Given its diminutive stature, you might have expected the slightly larger Sonic to cannibalize the tiny sibling's sales, but that hasn't happened. The Bowtie moved 39,159 Sparks in the US in 2014, a 14.7 percent boost from the previous year. Now at the 2015 New York Auto Show, the latest generation is being unveiled with a new engine and much improved styling. Replacing the current 1.2-liter four-cylinder is an all-aluminum 1.4-liter unit making 98 horsepower. That still doesn't sound like much, but it's 16 percent more than the 2015 Spark. The new mill can be connected to either a five-speed manual or a continuously variable transmission with which Chevy estimates 40 miles per gallon highway fuel economy. The 2016 Spark also gets a longer wheelbase and 1.6-inch lower overall height. Combined with more elliptical headlights at the front, the changes make for a somewhat more sleek appearance than the current, boxy model. The platform underneath is more rigid as well, and Chevy claims the latest underpinnings mean better handling and lower NHV levels inside. The little hatch isn't growing up too much, though, and gets a trio of new colors that sound like jellybean flavors: Toasted Marshmallow, Kalamata and Splash. Chevy is packing the interior with better quality materials and improved tech. Chevy's latest seven-inch MyLink system sits in the center stack with a capacitive touchscreen, and it now comes with a physical volume control and other buttons for easier use. All models also get a rearview camera, and a LCD instrument cluster remains in front of the driver. The available suite of safety systems includes Forward Collision Alert, Lane Departure Warning and Side Blind Spot Alert. The 2016 Spark goes on sale in the US in the fourth quarter of 2015 and is produced in South Korea. Expect a gallery showing off all its new styling from the New York show floor soon.

Recharge Wrap-up: EVs poll well in Portland, Tesla seeks office space

In a poll of drivers in Portland, more than 80 percent said they would be driving an EV in the next 10 years if they weren't already. The poll was small and not scientific, with just 218 votes cast, but it does reflect a slice of a certain population with changing attitudes toward electric mobility, and 80 percent is an impressive figure. Additionally, 43 percent of respondents planned to have an EV in the next five years, and only 18 percent said they prefer gasoline-powered vehicles. With EVs in many ways repeating the adoption process that hybrids went through a decade ago, the five- or ten-year timeframe for more widespread use seems only natural. His Chevrolet Volt has been ticketed for parking six times since he took office. Granted, those street-sweeping signs are tough to keep track of, but his car has been photographed blocking at a bus stop while grabbing a burrito (who hasn't sinned in the name of a delicious burrito?), and was even caught parked in a crosswalk. As the electric car company continues to search for a place to build its $4- to $5-billion battery Gigafactory, it also needs some real estate to expand its operations near its Palo Alto home. Tesla has expanded from 3,000 to 6,000 California-based employees since the end of 2012, and plans to add 500 more by the end of the year. It is currently looking for 200,000 to 300,000 square feet of office space close to its Fremont factory, according to sources in the real estate industry.
